If a school says they are not able to issue an E-2 visa for the work they are offering, does that mean they are operating illegally?

Either they are illegal (not a paying taxes and what not) or they are too small to hire a foreigner legally. A school has to be a certain size (area as well as students) to hire a foreigner. At least that's the way it was a few years ago.

It means that they havent applied to immigration or someone to be able to hire an English teacher...It's basically a private.

Thanks for the responses.

Actually, this was not in reference to a particular job.

I have seen a lot of jobs saying they offer E-2's and then others don't say (depends on the job site). Anyways, I want to get an E-2 for whatever work I'm doing, so I wanted to know if they are really lying when they make up the story about how they can't get me a visa for the contract. hehe
