Thanks Glen!
Is there any way they can deny you your vacation days even if you give the proper 30-day notice beforehand (as my contract notes)?
I didn't see it at the Labor Board website.. actually want they want to do is have me take all my vacation days at the end of my contract.. or near the end. |

Hi Tiger B.
Heads up on the vacation at the end of the contract! DO NOT DO IT. I don-t know if you remember Lesza and her experience with not getting her severence but one reason the labour Board denied it for her was that she worked 364 days of her contract becasue of some holiday at the end. Please be careful about the days at the end of your contract.

Yeah, I really don't intend to take any on my last days.. can't believe the things they do to cheat you out of money at times. Particularly when you work one solid year depending on that nearly 2 million - its a serious pot of money!
But I will particularly keep it in mind to work those days if it does come to that. |

The hogwons are money grubbers. They are totaly insensitive to the personnel needs of it's employees, and they have no concept of cultural shock. They could at least do some background work to find out what foreigners need, and what emergencies might occur to warrant us foreigners needing special time off.
Further more they are only concerned about using teachers, and squeezing them for their last drop of blood. Bang! Bang! And that's the majority of them. Koreans are very materialistic. No concept of class or quality time, hence that drive to make money,money,money over the dead bodies of any Tom, Dick or Harry. |

TB - 2 ways I see you can go with this.
1. Do what you want - take your vacation and risk the 2 Million Severance
2. Listen to them and collect the 2 Million at the end of contract
Can you trust that theywon't screw you on the severance after you do as they ask?
If not, I'd take a hit on this one and just blow them off and head to the Phils.
Have other instructors received their severance from this company or is there a pattern here of problems? |

Actually I can't trust them to get my severance. They fire Korean staff members about as quickly as going to get a drink of water. The company is relatively new and failing as well. Only one teacher has finished the contract, and one more will finish in January. The other 6-7 who have passed through have quit. I actually quite like teaching there, but this little thing has me a bit twisted.
So far everyone has actually been paid including the ones who quit and gave notices and the one who did finish his contract. If the company doesn't just fold, then I should be fine. If I do everything they say, there would be a higher chance of making it to the end. I'm more concerned of NOT going to the Philippines and having the company just fold shortly after I've missed out on the opportunity.
At this point.. I talked to the person who I'd be meeting in Philippines and they'll just come here to Korea instead. There is a cool festival going on there.. so would like to have attended that.. once a year.. 3rd week of January in Cebu. So kind of sucks to miss that.. hmm..
I'll still have to figure it out.. I'm going to let it die at work while I'm on this Thailand vacation.. but that Philippines trip was even more important to me.. so kind of sucks.. I might just take the sick days and figure it out. Just hate to come back and not have a job.. as well being back in Korea again for no reason. |

| This may sound like a stupid question - but - is it still illegal for me to only have 5 days vacation a year, if i signed the contract? I want to have the correct facts before i bale them up about it. |

Anytime a contract violates actual labor law that part of the contract is void.
In some instances there should be or can be fines given to the employer.
I remember reading especially about penalty clauses.
I had a contract that said " if the teacher fails to complete the contract through his or her own fault they shall pay back to the hagwon 4,000,000 won". It was a moot point because they could be faced with a 5,000,000 won fine for having this in (my understanding).
For vacation you get 10 days.
Try getting a numb skull director to agree with this though.
I remember telling my hagwon about the penalty clause. I said it was illegal as far as I knew. They said "Is any of this legal?" Really. Exact words. What the funk!!!!
When your boss is in the English business you have to be in the money for no work business. |
