So, I have posted this before, and have had different responses. Same with people I have asked in person.

So, here are my questions, once more. Promise, last time.

I have a DUI on my record in the U.S. That given...

1. Will I have to get a criminal background check to get my VISA extended with my current employer?

2. If I found a school after my 10-month mark, could I transfer my current VISA without a criminal background check?

1. Yes, unless you obtained your visa after December 15, 2007 and hence already provided a criminal background check to Immigration.
2. No. The grace period expired March 15, 2008. After that date, all visa transfers and extensions require a criminal background check (unless you have already provided one to Immi post-12/15/2007).
