Schoolmaster Guilty of Photographing Girl�s Thigh

A school headmaster was found guilty of taking photographs of a schoolgirl's thigh with his mobile phone camera.

The Seoul Central District Court on Thursday slapped a 1 million won ($1,000) fine on the school principal, identified only by his last name, Lee, on charges of sexual assault.

The incident took place last October when the drunk principal sat next to a high school girl wearing a miniskirt on a bus on his way home one night. He took out his mobile phone and started taking pictures of her thigh, about 20 centimeters above the knee. When the girl tried to stop him, the man allegedly slapped her.

The accused claimed the bus caused him to suddenly lean toward the girl as it turned, accidentally causing him to take a picture of the girl when he actually intended to take a picture of himself.

However, the judge said the photographs the accused took indicated he intended to take pictures of the girl from the start.

``Taking pictures is a different story from peeping because they can be sent to other people and be abused. The accuser's wearing of miniskirt in public does not mean she allowed herself to be a victim of a crime,''' he added.

This is the first time a court has defined ``sneaky photographing'' under the category of sexual assault.

Taking pictures women's body parts on subways and buses has been a headache in society for quite a long time. Pictures are often uploaded online, where tens of thousands of people use them ``inappropriately.''

Related laws stipulate that those who take or exhibit pictures of body parts that could cause lust or shame be imprisoned up to five years or pay up to 10 million won in fines.

However, there was criticism that courts have been reluctant to charge people with the regulation. In March, the Supreme Court sentenced a man who had taken tens of pictures of women's legs at metros not guilty because the court couldn't ``define'' which body part ``would bring sexual shame to a victim'' and the woman was not aware of her photo being taken.

Gotta love how they mention as an aside that he slapped the girl after she tried to stop him from taking pictures up her skirt then go on to talk only about sexual misconduct forgetting about the obvious assault and battery.

Even when Korea seems to be getting it's act together (legally), people still mock it's progress. I'm glad they did something about it, even if it's small. They're going in the right direction with this case.

Sounds a bit like "Claire's Knee."

Can you get arrested for photographing a girl's knee here?

How about her hands?

Personally, I think a girl's neck is sexy, but not her thighs. Does that mean it is legal for me to photograph her thighs, but not her neck, since I might actually enjoy looking at photos of her neck?

How about people who are turned on by sexy ears? And some women are turned on by having their ears nibbled. Is photographing ears illegal in Korea?

Heck, I hear some women have erogenous zones all over their bodies. Does this mean we can't take a picture of any part of them?

No, this is not the right direction, Korea.

Some countries, like America, have too many laws. They think the answer to everything is to pass another law, and another, and another.

The principal should have gotten socked with a battery charge. He should have been disciplined professionally. In the U.S., I guess he could have been charged with being drunk and disorderly, but this just gets you promoted here.

Actually, wasn't he humiliated plenty just from the publicity?

But getting arrested for taking a picture of a girl's thigh?

Does this extend to clothing? I like women's footwear, so I guess I better not take any photos of them.

I'm with you on this one, flummuxt, and the other poster who pointed out that the imaginary assault of the photo was more significant than the actual one of slapping.

Emulating the West here is not the right direction.

Pipe down over there! You're raining on the "western male bitch-fest" parade! If life were truly perfect, I could take all the upskirt little girl pictures I wanted and no activist judge would stop me! I assure you, if I had a daughter I would be fine with creepy old drunken men attempting to take pictures of her naughty bits. She was wearing a skirt, so she was obviously asking for it!

Yeah. Did you check out the remarks section on that article? Ol' Thiessen, posting under the name dakotatat since his archaeologist moniker there was banned, has some real doozies.

Where do I turn myself in?

I, too, have sat on a bus and lusted after a young girl's thigh.

It is weighing on my conscience, especially now that I know it is illegal in Korea. I want to pay my debts to society.

I am guilty.

What should I do?
