Letter of release required, even after E2 expires?

I did a search twice, but I'm not pullling up anything.

I'm a few weeks away from completing a contract at a bad school. My boss is basically saying "without a letter of release, you won't work in Korea again" I've been told that I will only get a letter of release if I work beyond my contract expiration date, additional days which I do not want to work, and do not approve of. The situation is basically "work all the overtime I tell you to, or no letter of release when your contract is up."

My question is, if I finish my contract, and leave Korea, then come back after my old E2 has expired, do I really still need a letter of release from my first job to get another job? I'll be finishing my contract, but my shady boss is trying to make my life hell because I decided not to re-new or extend my contract.

I thought that I didn't need one unless I was trying to extend my current visa. With all the people who have done runners and gotten new jobs later, surely they didn't need a letter of release. Immigration in Seoul told me otherwise yesterday, saying that even if I finish the contract and my current visa expires, I still need a letter of release from my original employer to get a new E2. Who is right?

Unless something has radically changed with the new E-2 visa regs, if you finish your contract you do not need a letter of release. Tell your boss to go *beep* himself.

With the LOR you can get your current E2 visa transferred to a new employer. You'll also need to have your CRC and you'll have to do the medial exam to get your ARC.

With no LOR, your visa will expire naturally and you can apply for a new E2 visa with a new employer. You'll still need to supply the CRC and get a medical exam to get your ARC.

It's basically a matter of how long you are willing to wait to start a new job. If you need a new job right away, then you'll need the LOR so you can do the visa transfer. If you aren't in any hurry, then go home, get your docs together and line up a new job from there.

Teachers have only just begun to go through this process an there have not been many reports so maybe someone who has transferred visa sponsorship recently can post his/her experience and the process.

Liar, liar, pants on fire....

He is full of crap. When your visa expires naturally or is canceled you are free to find a new job without your previous employers approval, knowledge or consideration.

In fact, after your visa expires (save a photocopy of your ARC)

and when you return to Korea, file a claim for your unpaid pension (assuming you qualify for a refund). That will certainly improve his day.

IF he was charging you 3.3% or 5% for your taxes it would be fun to file a complaint with the tax man too... that would REALLY improve things for him (especially since you said it was a crapwon).

Do your best to improve life for him.

Do you have the name of the person who told you this? I have a direct connection to many people in Immigration and they have asked me to let them know when these things happen so they can go back and fix the problems.

Last time I went to immi, I needed to pay to get that stamp. The woman pointed to the ceiling and told me to go upstairs. I was confused as the other times I been there (twice before), I'd had to go to the basement.

"Go UPstairs?" I asked. She nodded. I asked in Korean. She answered, "Yes, upstairs," in Korean.

I went upstairs.

Do you think the stamp buying spot was there? No. It was--you guessed it--in the basement. When I got back she said, "You took a long time."

I said, as nicely as I could, "It was downstairs, not upstairs."

"Yes, that's what I said," she said.

The point of this story?

Immi is full of idiots.
