I'm sure it's covered somewhere else on this board, but I can't seem to find it. I'm changing schools, getting a new E2 visa, and wondering how to start the process to get a criminal background check. Any advice? |

Are you doing this at home or in Korea?
Either way, find your state's law enforcement division's website and start the search for info there. Should be email or contact numbers somewhere.
Despite the fact that Korea does not accept online checks, I'll bet you can start the application process online. Then request the hard copy signed by their officials to be mailed to your address. (might need a stateside address for that though?)
It doesn't make much sense to me why you need this if you haven't lived there, but someone has suggested that data *judgements?* can be added since. |

You have to get finger printed to get the CBC. I had mine done in Seoul near Insadong while I was on holiday from teaching in China. I am also from New York originally. Send it EMS to the Criminal Justice department. I believe it costs $50.00 for the CBC. I was able to get a money order at Standard Chartered Bank in the Kyobo Building at Gwanghwamun. There is a post office nearby. The CBC will have to be sent to a stateside address. Then to make it acceptable to Korean immigration you have to get an apostille. Look up the site for the Secretary of State for New York. Anything outside of New York City goes to Albany. It costs $10.00 for the apostille. I'm not sure if it has to go to a stateside address or not. Hope that helps. |

So, is it then just a statewide criminal background check - not a national one? Last year, I got a 'county-wide' criminal background check - perhaps the most useless piece of paper I've ever received. I went to the main police station, they searched my name, then asked if I had committed any crimes, and signed a little piece of paper. They didn't even ask to see my drivers license or for other names (I had recently gotten married and changed my name). I didn't think the Koreans would accept such a thing, but they did (fortunately, other than some speeding tickets in another state I'm clean, but I could have murdered a thousand people a county over and still had a clean criminal background check).
Anyway, my question is: is this simply a statewide background check? Even the statewide check in my state doesn't require fingerprints! The closest Korean consulate is a state away - will that change things? |

A county check is acceptable to Korean Immigration. Their regs state that the check can be issued by federal, state, provincial, or local authorities. Don't waste your time and money doing more than what the law requires.
And the location of the nearest Korean consulate matters not a whit if you're already in Korea on an E-2 and are obtaining your check while still in Korea. Unless you have a "black mark" on your immigration file (or are planning to go home and get your new visa in the US while you're there), you should have zero interaction with any Korean consulate in the US. |

Absolutely not.
Reason 1: Background checks must be issued by a government authority.
Reason 2: Online checks are no longer accepted, even if issued by a government authority.

I am confused. What is the difference between a government authority and a state agency? They both sound the same to me. I got an online check from the state of texas dept. of public safety. I have not taken it to immigration yet since the new law is confusing. Will immigration take I have already taken it to US embassy for an affadavit.?? |

Sorry, but you're out of luck.
Immigration stopped accepting any and all online background checks in mid-July. Even if it was issued by the State of Texas, and even if it has the embassy affidavit, it will not be accepted. |

How can I get a background check from Tennessee, then?
This was what I got when I did a search on Tennessee background checks. |
