It really can be a bizarre country sometimes. The extent to which "rights" claptrap has invaded all aspects of public discourse is in my opinion extremely unhealthy. |

But Canadian authorities are not reasonining like this. They have deemed obsesity "a disability" as in our "Americans with Disabilities Act." And they have included obese people with wheelchairbound people, etc. Same thing to them. Disabled people require special protections for inclusion in society, etc.
I must say, I remain disatissfied with this precedent and I hope it does not spread southward... |
Are you kidding? The US is the poster boy for people not taking responsibility for their actions and then finding someone to sue for it as well!

This is absolutely pathetic. Canuckistan, there is one country in the world where the Supreme Court has upheld (albiet by refusing to take the case, I don't know how that works . . . ) special rights of the obese to fly airplanes. And you're attributing this on the US?
Major loss of credibility, Canuckistan.

When and how did this start? This is fascinating.
Anybody know anything about Canadian Constitutional law? I can't search for Canadian cases on Westlaw. |

| Id rather have fatties with two seats then having to sit beside one. My god, there isn't enough room in those seats as it is, nevermind a person with arm fat drooped past your arm rest and into your lap. Give these people 2 seats, for the concern and consideration of others who may be unlucky and forced to sit beside them. |

| At the risk of further inflaming this ridiculous argument, but what happens on airplanes that have a 3x3x3 or similar arrangements. The basic functions of a seat precludes someone from sitting halfway in between two of them. So in the case of a 3 seat section is the airline supposed to vacate one seat only to make the third seat customer suffer? |

Obese have right to 2 airline seats: Canada court
| Quote: |
OTTAWA (Reuters) - Obese people have the right to two seats for the price of one on flights within Canada, the Supreme Court of Canada ruled on Thursday.
The high court declined to hear an appeal by Canadian airlines of a decision by the Canadian Transportation Agency that people who are "functionally disabled by obesity" deserve to have two seats for one fare.
The airlines had lost an appeal at the Federal Court of Appeal in May and had sought to launch a fresh appeal at the Supreme Court. The court's decision not to hear a new appeal means the one-person-one-fare policy stands.
The appeal had been launched by Air Canada, Air Canada Jazz and WestJet. |
Are you serious? They have a RIGHT to two seats for the price of one. A "RIGHT"? Are they serious and this was passed through legislation to create this right?
I have no problem with larger people getting two seats, particularly if the airlines offer it individually...but the government instituting it is as a'right' with the idea of 'two-seats-for-one' deal...c'mon.
Poor people have a 'right to eat', but that doesn't mean the government should come in and make laws for 'two-for-one' deals at all restaurants because of it.
In the end, it just means everyone in Canada will pay slightly higher airfares depending on how low the 'obesity' level is to qualify for this 'right'.
I'm most curious how they will gauge 'obesity'...as most western countries, it is something like 30% of the population is termed 'obese'. It will be interesting to see what the Canadian government will use to define obesity. |

Its not a right. Nowhere does the decision call it a right. That's the reporter's addition.
There's a statute that allows those with disabilities compensation if they are presented with an undue obstacle. The Parliament didn't define disability in the statute, so the plaintiff introduced the WHO's ICF determination, and Air Canada did not object! Point is, obesity MAY constitute a disability, but its referenced to context. I.e., is there an undue obstacle?
This is so far removed from giving all obese a right to two seats that the reporter should be fired. I mean, seroiusly.
Thanks to Canuckistan for providing the case. |

Welcome to journalism.
I wish I had the cite, but several years ago a local Las Vegas newsstation reported a national poll where pollsters had asked Americans where they preferred to retire. This poll ranked Las Vegas seventh or eighth in the nation. Miami, San Diego, others ranked higher.
But the local newsstation became outraged. And they reported the story like this: "Well, according to this poll, Americans think Las Vegas is a nice place to visit, but you wouldn't wanna live there..."
Get real, I thought. But I noticed the same thing: those who report the news sometimes not only spin it, but they alter it to serve their own purposes. |

Anyway, I'm not obese, but I am tall and never have enough legroom. I want a special seat, too. |
