My criminal check shows an arrest for drink driving but then nfa (No further Action)...actually it says, No Bail, No court Apprearance, No Plea, NFA

What happened was the roadside breathalyser went into the red so I was arrested on suspicion of drink-driving, but at the police station the specimen was green so I was not charged. Will this be ok to get a visa?


Can any UK teachers tell me if they had any non-conviction data/arrest data on their criminal certificate and if so did you still get a visa?

if u weren't charged you should be able to to use disclosure scotland for basic disclosure as it only lists charges and convictions

I just looked at Disclosure Scotland and it says you can only get a basic disclosure online.

Is this ok or do you need a standard disclosure?

there are 3, basic, standard and enhanced. Enhanced are for kids and vulnerable adults, but I am only going to be teaching businessmen and adult students, but is a basic one ok or only standard, cos u cant get a standard one online.

I used the BD from Disclosure Scotland and it worked fine (this March).

Mine took about 3 weeks because they wanted more information. They tend to post letters to ask for this information rather than phoning or emailing you. This makes the whole process slower! I think they do that to see if you are really living at that address. They sent me a letter to ask me for proof of address in the form of a bank statement or photocopy of my passport (which you can scan and email to them). I think if you have all the information and documents you need, you can expect to receive it within 10 days

I was in a similar situation and used Disclosure Scotland. No problems at all.

So the basic disclosures DONT show up if you were arrested at the roadside for drink driving? Coz my Subject Access Request DOES....even though as i said I was not charged in the end coz the machine at the station was green. I still had the old mug shots, fingerprints and DNA taken though.

Really speaking, I was hoping someone else would say they had non-conviction data and that it was ok to use, but at the moment I am not sure.

Ok, you mean you are renewing your visa or just applying for one for the first time?

Mind you, you were actually charged and yours is an offence against the person, whereas mine is just a traffic "criminal" offence but I was not charged. Anyway, yeh let me know, I got mine within two weeks. I called Disclosure Scotland today but they were closed, and their voicemail said they have a backlog and straight forward ones are taking 3 weeks.

I got a note on my criminal record for a time 3 years ago when I was arrested for being drunk & disorderly outside my apartment! Shocked to see it there as I'd long forgotten about it!


Anyway, it didn't cause any problem at Daegu immigration but then again, my hagwon boss did my visa extension for me and i guess he explained to them about the no court appearance if they asked.

If I was you, I'd take a Korean friend along with you...

I am in the UK still mate, so wouldn't I get my visa authorised here first before I went? You have to have a chat at the embassy now for some reason if you are going to Korea for the first time.
Glad that someone else has got non-conviction data on their check and still got a visa with it.

Sorry, I'm up for visa renewal. Been here over 4 years. So maybe different situation to OP. I'm not sure how the charge will go down but will update.

I was arrested, charged but found not guilty of a semi-serious charge. I used Disclosure Scotland and it showed nothing. No problems at all.
