My recruiter told me that Canadians no longer have to include the vulnerable sector search with their background check. Has anyone else been told this? Also, this is my second time going, and this time they told me that I have to get the background check notarized both locally then agian by the Korean Consulate. Is this true?

Yes, as of Jan. 2009 Canadians DO NOT NEED A VSS. All you need is either a local background check from your local police force or your provincial police force, or an RCMP check. I do not recommend the RCMP check as it can take months to get one.

Since Canada is not a signatory to the Hague Convention on Apostilles you cannot get any documents apostilled in Canada. Instead, you need to take your background check to a public notary first, have them notarize it, then take it to the nearest Korean diplomatic post and have them stamp it. Before you do this you should contact the diplomatic post first to make sure you don't need anything else (every Korean diplomatic post seems to have its "own rules" for processing a visa, better to check before hand).

Could you please post the link or info as to where you heard this? Not that I'm doubting you...but it would be beneficial to the Canadians on this site.

Sorry, I don't have a link for it. This is what I was told by my Administration Officers and I have hired Canadians since Jan. '09 without a VSS..

I suspect that Immigration and the Ministry of Justice didn't want to make a press conference about this as that whole fiasco made them look tards.

After I was interviewed in the Joongang Ilbo about the VSS http://joongangdaily.joins.com/article/view.asp?aid=2897140 (I was the source for this article) the Ministry of Justice finally admitted that they had never bothered to inform the Canadian Embassy about the VSS requirements. I later found out that a Korean consular official in Toronto had heard about these checks (without bothering to do any research on them or check with Canadian authorities) and recommended them for Canadian teachers. The MOJ agreed, again without bothering to check with Canadian authorities. The Canadian Embassy finally told the MOJ late last year that the VSS is ONLY for domestic purposes in Canada and it is illegal to be used overseas.

I took a peek at the immigration site which I believe used to mention the VSS. There is no word on it now. It states the following regarding Canadians:

Issuance of proof of (lack of) criminal records

o Consulates located in Korea cannot issue proof of criminal records to individuals currently.
o Korean government requires a proof of criminal records issued by the relevant nation�s government for its citizens to use for any number of international activities, such as employment. It will accept records issued by the federal, provincial, state, local authorities.
※ The document is valid for six months form Criminal background Check issuing date. Please check the local government resources to find out how you can obtain one.

Revision of Foreign Language Instructor (E-2) visa issuance requirements

* Required submission of proof of criminal records
(the records must be affixed with the relevant nation�s Apostille or their consulates in Korea)
※ Nationals of countries that have not signed the Apostille treaty, (Canada, China, etc) must get their records verified by their local Korean consulate, and those already in Korea who were issued their criminal records from their consulates in Korea have no need for an Apostille
(If they have previous criminal records, they cannot be issued a certificate of visa issuance unless otherwise specified)
※ Exceptions are made if the nature of the crime is light and does not affect their ability as a teacher


I guess it would be best to check with the embassy!
