So since we need this proof of residency thing, I guess we have to filll out the 8802. So I have some questions.
I'm working at a public elementary school through GEPIK since March, if this is important.
Also, I did not make any income during the year of 2008, because I was a student.
Taxpayer ID Number = I don't remember if I have this. Can I use SSN?
Line 2. Applicant's Address. Is this my US address or the Korea address? I've only been in Korea for two months. And if it's my US address, would it be my parents address (which I lived the one month before coming to Korea and my only local address in the states) or my former apartment, which I lived prior to that but not having any access to there anymore.

if you've only been here for 2 months, then you're filing for this year right? 2009?...... |

I thought it wanted an US address as "proof of residency" that I actually lived in the states back in 2008 (2007)? |

sheisaeval If you are here only 2 months then you are actually filing for the previous year which would be 2008. Even if you were a student and did file with the IRS, you can use this as your verification year. Remember, you must have filed in that year if this is the year you are selecting for verification. So if the last time you actually filed with the IRS was 2007, then use that year.
For line 2 the form should be the address where you were living when the request for verification is being requested, even if you were residing outside of your home country. Of course, it means you must have filed taxes in your home country.
Here is some more information about who can apply for the form 6166 using the 8802:

So read carefully and then fill out the forms accordingly.

So it would be my 2007 address if I file for 2007 and my 2008 address if I file for 2008?

1. If you did file for 2008 then it would be that address UNLESS you filed as a nonresident (Form 1040NR). Then you would have to go back to the last year you actually filed taxes as a resident, living in the States.
2. You would be right in making this the year of verification IF you were in fact living in the US. |

The IRS has a 12 page instruction sheet for this form if you put in "8802" in their search box. If you didn't work before you have to request proof of non-filing status document before you even fill out the 8802. I think it's line 5 and you check "Other" if you didn't file taxes and attach the other documents.
I called the IRS today about this, and a representative told me they just changed the rules on this form and even had a meeting about it with the new changes before I called. Be wary of taking advice about it online here because even the people who worked at the IRS had to double check everything with the new changes. |

Thanks for pointing this out. I have the new forms opened up right now looking at the instructions and the form. Non-Filing residents still have to fill out the form and would receive the verification based off of the family member they were a legal dependent under. If the individual did file then the former applies with regard to residency. This is why it is such a big issue because of determining the last residency year. However, the IRS will verify information based on records of filings from taxpayers.
You are also right about taking advice from an online source. |

On the 8802 you choose what year you want the certification for. I have not seen anything saying it has to be for 2008. Last time I filed taxes was in 2004, so that is the certification I am applying for. Tax office was unclear on what year they want. |

I was just thinking about the logic and reasoning behind this. It occurred to me that Amsterdam or some other country was taking heat from the US lately because of people using off-shore accounts to defraud the IRS of tax revenue. Not that the NETs money would compare to a situation like this, but it is likely that Korea is responding in kind for a request (from the US in particular) to find out how many people may be "hiding" so to speak and attempting to shirk their responsibilities as taxpayers. Of course, if the Korean government selects one nation, then they must include all of the host countries from which NETs are recruited. (This is only speculation on my part)
According to the instructions for the 8802, you can only apply for the 6166 IF you have filed as a US resident for the year you are verifying. So this will be your year for determining eligibility. |

Lol....yea the IRS wants those hiding millions in Swiss bank accts. We dont even come close to making over $85,000. Maybe Koreans think we make too much money? |

Nah, I think maybe they just want to keep the tax money that they would normally have to refund to the teachers. If they make the hoops too hard to jump through, a bunch of us won't do it. |

Amen to that. It is not a straight forward form with it's 12 pages of instructions. I have an MBA and used to file my own corporate tax returns but I could not understand this form. I called the help number listed on the instructions. Even they seemed unsure how to fill it out.
Long story short, after sending in the form, expect 8 to 12 weeks to get your 6166 which is what you need here in Korea.
Call the IRS. Don't trust "us". |

maybe it is the US address >_> I'm starting to get confused too~
edit: actually for you.. you weren't even in korea in 2008... should be your US address.
I just asked a friend who filed hers back in December/January.. she wrote her Korean address for #2. |

boy this is a real pain in the ass. so, i've been here since september 08. so should I request the certificate for 2008 or 2009?
the tax period that certification will be based on...that means the last return i filed right? which was for 2008.
one more...
if i put down that I'm requesting certification for 2009, then I have to write out a statement in line 10 saying i will continue to be a us citizen blah blah blah?
also, a side note, does anyone else feel dumber for having read those instructions? I'm not even sure what year I'm living in anymore. |
