On 7/24 I mailed my FBI CBC to the SoS for West Virginia for apostille. Earlier in the week I had contacted the office to confirm all I needed was to include the fingerprint card, destination country, and $10 payment.
On the 30th, I received the following letter:
"Thank you for your request to have your document authenticated. Until further notice as of July 27, 2009 this is the proper procedure to follow when having an FBI background check processed.
The fingerprint card must already have a statement signed by the person whose prints are on the card. The statement is just a basic statement similar to this:
I, name on card, acknowledge the attached fingerprint card is an original obtained by the Federal Bureau of Investigation located in Clarksburg, West Virginia. Sign your name and date it.
It then needs t obe notarized by a West Virginia Notary and the certification will be done on that notary. This needs to be done on a separate sheet of paper not on the fingerprint card.
If you have any questions, please feel free to contact our office at 304-558-8000. You may direct your calls to the Authentication Division in Business and Licensing Division."
I then called because I was confused as to why the office took my payment without including any apostille document. There was no seal on the FBI CBC. I was told that there was an addendum to the document - that according to the Department of State (I'm unsure whether this was the Federal or State office) this process can now be done by any Secretary of State and instructed me have this done in my home state.

Bureaucracy at it's finest.
I can tell you one thing. The state that you intend to have apostille your document has to be the same state you get the notary statement in.
Are you having your docs sent to an out-of-state address? (not WV?) Maybe they think you'll be having it notarized out-of-state. |

Unfortunately for us (midwesterners at least), we have to send our fingerprints to WV, then have the WV Sec of State apostille it. That also requires a WV notary.
Luckily we haven't reached the point where we need national checks yet. I see that day coming soon though. |

hmmm... do I see a roadtrip in Zippy's future if he comes home next year to renew his contract? His CBC was a piece of cake last year when they were still accepting online ones.
Still, it seems to me that the letter is telling him to get it notarized at home and send it to his OWN state's SOS (or whatever dept. there does the apostille). |

Will immigration still accept a signed affidavit from the embassy? I thought that was the easiest way. |

For those of us whose states don't do statewide background checks (Arizona), that day has already come. |

wow...i sent my fbi cbc to the WV place and they notarized and did an apotille...in the beginning of july. all they asked was that i sent a cover letter with it specifying what country the apostille was for, my contact info and payment. |
