Article 36 (Liquidation of Money and Valuables)
If a worker dies or retires, an employer shall pay the wages, compensations, and other money or valuables within 14 days after the cause for such payment has occurred; however, the period, under special circumstances, may be extended by the mutual agreement between the parties concerned.

Does that mean they have to pay within 14 days after the day they promised to pay me or they have to pay within 14 days my contract term ends?
My contract term end August 18th and they told me they'll pay me on September 7th which I think is totally ridiculous.
With this law does it mean I have to get paid before September 1st or September 21st? |

They have to pay you within 14 days of the contracts ending. After that time, you can go to the labor board. |

Another thing, "retirement" means me quitting the job right? Not, retiring because I'm old and can't work anymore? |

Heres the rationale some public school systems are using.
Your primary "employer" (the POE) is required to disburse moneys owed within 14 days. Problem then is its sent to the local office of education, who then have to forward it to your school admin office, who finally pass it on to you.
The POE has met its legal obligation & is technically in the clear, but subsequent bureaucratic lags are systemic.
Gangwondo payouts are taking about a month. Annoying, sure, but I've yet to hear of anyone here not getting everything due eventually. |
