Hi-
I'm working on getting my documents in order, but I am having a problem with my criminal background check. I went to Arizona's Department of Public Safety and got my fingerprints done and received a letter in the mail. The letter is really generic and pretty much just says that if anything was found, it would be attached, otherwise the letter was the only correspondence I would receive. I don't have a record so there was nothing attached, just the letter. I'm wondering if this is sufficient or what I need to do? Every state handles their background checks differently, so I need to find someone from AZ and see what they did. Any help would be appreciated. Thanks! |

Ok, this is the important part. Does it say anywhere on the letter "No Records Found"? |

This is what it says (in part): "The review of your Arizona criminal record is complete. If no Arizona criminal record was found within the Central State Repository, this is the only correspondence you will receive. If a record was found, fingerprint verification was completed and a copy of the criminal record will be enclosed." There was nothing enclosed. |

I'm in Prescott and I just went to the local police station, they wrote me a letter which was notarized and then I had it apostilled. Immigration accepted it without any problems. |

I would go with that. Just make sure there are no staple holes or anything in the letter.
And don't just trust in blind luck that immigration will accept local background checks. There are recent posts on this site where people have been rejected by immigration because they did not have the proper background check. Yes, some people got lucky and had lazy immigration officers, but don't count on that. |

According to this thread, the Arizona DPS check is NOT sufficient:

That thread is from last year, when we could opt to get a background check from a local police department because local checks were acceptable. However, some recent threads (such as the one below) are now saying that local checks are no longer acceptable.

Since there is no way to get a state background check, and since local checks are no longer accepted, that leaves us no choice other than to get a national (FBI) check. Perhaps immigration changed the rules again. I'm not sure how recently the previous poster submitted the local Prescott check to immigration. But I ordered an FBI check just to be on the safe side. |

Hi,
My paperwork was submitted to Immigration on the 27th of July, and I got my issuance number 6 days later. On the 27th the rules had changed that you must have a state background check. I sent my visa application on the 7th of Aug. and had my 2 min. phone interview (as AZ is deemed too far) and was told that I'd get my visa that day. By Thurs. I had the visa. |

thank you everyone for responding. i went ahead and got a local one done only to be told by the recruiter that they can't accept local background checks. i guess i'll just try going through the fbi and see if they can rush it. |

I don't know whether FBI can rush these. Generally, it takes 2-3 months. If you are a nurse or musician, often the fingerprints become flat, and unreadable, Check carefully to see that you can see the ridges in the prints, otherwise, do them again. It always takes me 4 months to get my clearance. I happened to submit a copy of my fingerprint card, attached to the Apostille, and Immi. accepted it. The rule change was announced the 27th of July, just when my paperwork was starting the Immi. process. I guess that I got lucky. Best of luck to you. |

I'm from Tucson, but it seems to me that it would be easier and cheaper to just go and get my CBC done in LA while I'm there for my visa anyway, or I guess I could also do New Mexico or North Carolina...Anything wrong with this plan? |

I'm from AZ, and I just got it done at the local Tucson Police department, got it notarized there, and then sent it in the get apostilled.
I had no problem with SMOE accepting it, so I think that should be fine. |
