|

Hi again all,
I see different aspects of this issue have been covered, but my question is a little different than some I've seen on here.
I have read the Korean government bars anyone with any kind of criminal record from obtaining an E-2 visa. I had a very minor drug infraction at 18 - we'll say possession of pot paraphernalia.
I am now 28 and have had no legal problems since then. Would they be willing to forgive an infraction from so long ago? Since I was 18 and no longer a minor, I'm sure it's still on my record.
Any words of wisdom? |

Your only hope would be to check with your state about whether such minor charges can be dropped from your record after X number of years.
If not, forget about it.... |

Or....wait.....Where do you live?
I live in the US in Georgia a short drive to either Ala. or TN. I went to the police station in an adjoining county because it was closest and got a state CBC.
What if I had driven up to Chattanooga and applied for a CBC in TN?
....Well.....I just checked my background check I will be using to apply for a visa, and the 2nd page does say NCIC on it - and that covers the nation. I was a cop for a year, and that was the check done by dispatch when we called in a license.
So, I am taking it no matter what state you apply for the background check in, it will have a hit on an old arrest record regardless of what state it was in... |

There is a misguided belief that everyone deserves a "Second chance." Well, the reality is, sometime the mistakes we make stay will us. All we can do is suck it up and move on. If you have a criminal record, there is very little chance you will get hired in Korea. That's life. |

I thought the tests and police clearances were started due to a teacher having molested school children ?? |

If you have a drug record, you will be denied a visa.
If you think this was some youthful indiscretion, then take the advice above and seek to have it expunged from your record. You can seek a pardon or whatever else you need to do.
Only AFTER you have a clean record, can you safely apply for your visa.
Once you are denied in Korea, even if you are able to get a clean record, your old record will remain in the files of Korean Immigration and you may still be denied. |

I seem to remember something like that in Daegu around '06, but I can't find any reference to it. |

There is provision under Korean immigration law for an exception (to paraphrase) if the nature of the offence is light and does not affect the applicant's ability to teach.
Unfortunately, Ks see no drug-related conviction as 'light' and you would be wise to follow 'ontheway's' advice. |
