Hi,

I stumbled upon this...interesting...piece of information.

http://www.korealaw.com/node/47

My question to the other NTPs is this, Is your severance calculated into your monthly salary (check your contracts)? Also, when is your severance paid (e.g. yearly or when you leave)? Finally, I wonder if your university knows this!?!

hmm...not sure about others...but this seems to be an issue for those who don't belong to their university's private pension plan.

You don't need to be tenured to do that.

No.
Yearly.
Yes.

This was not the case at a hagwon I worked at quite a while back. They calculated my severence and paid me 1/12 of it every month with my regular monthly salary. When I finally left the school, I filed for severence according to the law. The school was livid because they were paying for it every month. Labor disagreed and made them pay me ANOTHER "severance" based on the new monthly salary I was being paid.

Rather than being paid X every month and then X as severence, my school was paying (X + 1/12X) every month with the assumption of paying zero severance at the end; they were then forced by Labor to pay me (X + 1/12X) as my severance as calculated by law. Sweet to stick it to them. They deserved it.

I'm on a private pension plan with my university, but receive no yearly end-of contract bonus or severance?

So I'm assuming this means nothing to me?

Same as me. This is what I am trying to figure out. According to the labor laws, it states that we, NTPs, are still entitled to severance whether it is paid yearly or at the end of the term you spend with the university in one lump sum.

I don't get it, they paid you your severance but then you screwed them for more and you call them jerks.

Okay,

I've spent way too much time on this last night and this morning. According to Korean law, if you are enrolled in a private pension scheme, then the employer does not have to pay severance, at all. This is a loop-hole because many NTPs are kicked out at year 3. This is done because around year 3, supposively, the uni. pays a lot more of your pension, so you make out better in the long run. Obviously, some schools don't want NTPs to get paid more, so they boot them.

Very Happy
