Hi Everyone,
I've been doing lots of research to figure out my options but one thing has stumped me. I am here on an E2 visa but I just quit my job after 2 weeks (it was horrendous). I'm now figuring out if I can get another job without a release letter (there's no way I'm getting one). I'm prepared to leave the country and reapply but I've read that without a release letter, I won't be able to get another job (or visa) until the end of my original contract. But what happens when I never received my alien card in the first place? Does that mean I'm technically still a tourist because the final part of the visa was never processed?
I'm sure I'm not the only person who has been in this situation and I'd appreciate your advice. |

In your case, the existence (or not) of the ARC is not relevant.
If you are American then you have to leave the country AND ensure at passport control that your multi-entry visa is canceled.
If you are from any other country then the simple act of leaving will cancel your visa/
At that point:
re-enter Korea
find a new job.
begin the visa process all over again from the start (complete with all new documents).
IF your new visa application (IN Korea) is rejected, go to Japan.
Look for a job who would be willing to sponsor you. (They) apply for a COE and when it arrives, make a visa run to the Japanese Embassy in Korea and get your Japanese work visa. You will need your Degree and TESOL (if you have one). No medical, no apostilles, no crap like Korea.

Do you have the visa or just the certificate number? In either case you will need the release letter to be able to more easily jump to another job.
I had a situation in which I had the certificate # but had not run to Japan. I had to make a strong and a bit costly case (based on transportation and a place to stay, not fines or anything) to immigration to cancel the certificate because of the job being a sham. Then I had to set up a new job w/ all new apostille, etc. NOT FUN AND NOT RECOMMENDED (if you can go work somewhere else in this type of case) |

| Thanks everyone for your help. I'm here on an Australian passport and my E2 visa was issued in February but as I mentioned before, I never got my alien card because I left work before that happened. I left because the school director was threatening and verbally abusing me. She was holding my original degrees so that I wouldn't leave and she wanted my passport to get my ARC but said she needed to keep it for 2 weeks. She was setting up other teachers' bank accounts (luckily I left before this) but using the school's address so she could see the statements. She was also taking money out of their wages to pay for internet, cable, cell phone but no one ever saw the bills so they have no idea if she was taking out more than necessary. I just want to know if I can leave the country and apply for a new visa before the end of my original contract since I doubt I'll be getting a release letter. If the post above is true about non USA countries having their visas cancelled automatically when leaving, then that should apply to me? I have to stay in Korea because I'm here to be with my fiance. |

Thanks for the reply but I've actually sought legal advice and it's illegal for her to do it. Some people might accept it because it's easier which is fine but my biggest problem was that she gave us no choice. It was forced on us. She was also reading our phone records and got us into trouble if we were talking to each other too much after hours. You may have a higher tolerance than me but I won't stand for such things, same with being screamed and lunged at continuously when I stand up for my rights. No job is worth that. |
