This might sound random, but I want to know for something Im writing....how would an illegal immigrant in the US register their child as a US citizen? (they are allowed to do this under birthright laws) Wouldnt they have to admit to being an illegal immigrant to get their children a passport?
PS please dont turn this into a lenghty anti US immigration discussion, I actually just want to know

The child would have a birth certificate issued from a hospital in some state in the USA. That is all that is needed for proof of citizenship for the child or anybody. Even though you may be listed as an alien on the child's certificate the INS cannot access that information, not without a federal court order and lots of luck for them to get one. I don't think parents are absolutely required to list thier birthplaces on the certificates anyway. Also one agency cannot provide info to another agency without permission from that individual. Therefore immigration and naturalization cannot get info from another agency (schools, hospitals, assistance agendcies) that you have provided with info about yourself. Employees of government agencies cannot give info personally to the INS, because if you find out about it you can sue the crap out of that individual or maybe the agency itself. |

Thanks thats a good reply....just wondering though.....would a Mexican - American with a birth certificate and no passport be able to leave the US to go to Mexico wihout a passport? (f their parents were from Mexico but they were born in the US)
And if they still had the birth certificate whilst in Mexico, would they be able to apply for a US passport from outisde the country? Its for something im writing. |

For your first question, I believe you need a Mexican or United States passport, but if you have dual citizenship, you have to declare yourself Mexican when entering Mexico, and present a Mexican passport. However, I am not 100% certain this is true for all people.
You can also use a PASScard but I have never used that before as it's quite new and I still have a passport.
To answer your second question, a guy I knew was born in the United States for citizenship (as were all of his siblings). He had to apply in the United States in person, but I believe it was at a post office. |
