Hello Fellow Korean ESL Teaching Professionals, and other assorted persons.
The final pay check is payable before you leave Korea, yes?
Please say yes. I called the MoLAB folks, they said before you leave. But, I can't seem to find anything specific in the legal code on their website. |

LoL, ya, they do have some very helpful people on here. It is a little late, so you might have to wait until tomorrow for their advice.
Just from what I know, there is no law. The only law says they have to pay you on your paydate (and you can't do anything if they don't until 14 days later).
If you're getting ready to leave, make sure you set up your online banking so you can transfer money back home.

I think severance is only legally payable 10 days after your contract ends. However, any good school is going to pay you everything (sal/flight/sev) before you leave.
If I worked for a hagwon, and they hadn't paid me on my last day, I'd be applying for an extension at Immigration and going into work everyday until they paid me everything.

If I was at a hagwon, I wouldn't leave the apartment until I was paid in full. |

Aren't you forgetting something? PENSION!!!!
Do as previously mentioned, set up online transfer. That way, if you don't get paid severance and final month's salary, it can be deposited to your Korean account. You could give the pension office your Korean account too. For me it was easier and skipped a step where you have to file for remittance.
The main reason why I kept my money in won is that the exchange rate isn't that good. I am hoping it will improve. So far it is, at a snail's pace though. If you can wait you might want to. If not, fill out the form for remittance. |

I've already bought my tickets for next year , and I am going to go to the Pension office next week to get the ball rolling on the pension.
I should have it when I finish up here. Problem, is that the company wants us to leave on the first of December, but didn't want to pay util the 24th of December. I don't see that happening. |

My understanding is that it takes a month AFTER you leave to process the paperwork.
1. You must present flight details showing you are leaving Korea.
2. They must verify with your current school you are finishing to get final payment figures.
3. I requested the amount I would receive, and they wanted to confirm with me when I would receive it.
If your school isn't going to pay before your last work day, then how do you expect the pension office to have your money? Seems like wishful thinking. |

What he is saying is that the pension office won't have all of your pension until the school pays it, so if you do it earlier than that, you will be leaving some behind. It might be one month's worth, or more. Some schools pay pension every 3 months in one lump. You can go by the pension office and check to see how much has been paid in currently.
When you get your pension, the office will only give you the money handed to them, not the money that "should have" been handed to them. |

I am aware, I check it online monthly. The most I'd lose would be 150 000 or so. That's worth having it before I leave, at least in my opinion. Two years pension.  |

Personally, I wouldn't worry about the pension before I leave because I already have my online transfers and other things ready. But that's just me. As long as you know the facts (and you do) then of course it's your choice.
I would worry about the final paycheck. Have you considered postponing your departure and just crashing at a friend's house until your payday? For people who aren't honest, it is so easy to not pay a teacher who has already left the country. Now if said teacher was staying in Korea until they are paid, it's a lot harder to screw you. |
