|
|
Hello fellow teachers,
My visa expires on January 26. My contract expires on February 28. I will stay in Korea for another year after that.
My employer told me to get a visa extension at the US Embassy in Seoul, and not at Korean Immigration in Daegu (closest one).
Is this correct (intuitively it seems not to be), or do I need to go to an immigration office in Daegu?
Hours of research on this has revealed nothing to me....
thanks
Doug

Head to your local immigration office to extend the visa.
Head the the US embassy to get a new passport. |

Really hours of study and searching!
Ok right now I am going to the search page (here on Dave's which sucks) and using one word - extension - I found 6 out of about 50 links on the first page that I could say would answer your question just by looking at the thread title. Using the word renewal I found 7 links that would help.
Try harder!
Also do not listen to to your boss - he is wrong - you have to go to Korean Immigration to get a renewal (of the E-2). He will have to go with you but it can be done in a morning. You consulate is only useful concerning American visas and paperwork like passports.
Here is a a riddle ----
Who knows more about immigration
A) Your basic Korean
B) A Korean Hagwon owner or boss
C) Your Korean Co-Teacher
D) A waygook who has been here a year.
D) 95 percent of the time.
Thru renewal might be a bit difficult concerning paperwork because of recent changes. |

Your visa expiry (the thing in your passport) is irrelevant.
When does your ARC expire? That is the date that matters.
AS to the extension of your status of sojourn (renew your contract and extend your stay) you need to go to your local immigration office (within 60 days of your ARC expiry).
You need:
new contract with new end date clearly shown
ARC
passport
application (signed by you)
fee (30k won)
copy of the school's business registration
Letter of guarantee (sponsorship) from the school
AND the 2 IFs
IF you used your original degree and transcripts for your visa application you will need to re-submit a copy of the degree with an apostille.
IF you did NOT submit an FBI check (you used a state one) for the original visa application you will need to obtain and submit one (with an apostille).

Hey ttompatz, thanks a lot for your lucid explanation.
Please clarify:
You wrote:
1. Your visa expiry (the thing in your passport) is irrelevant.
2. When does your ARC expire? That is the date that matters.
Question:
In sentence 1: "irrelevant" to what?
Sentence 2: "ARC" expiry "matters" to what?
My ARC expires on February 21, 2011. My visa on January 26. So, what does that mean to you?
Question: The Two IFs
Those damned ifs. The diploma will be no problem. The FBI CRC check should be here in about 8 weeks (mailing tomorrow), let's hope.
Question: Apostille
1. By "apostille" do you mean FBI seal/stamp with signature alone, or US Dept of State apostille stamp of the document bearing the FBI seal/stamp and signature?
2. Have you heard that we can do a sworn affadavit at the embassy in lieu of a US Dept of State apostille stamp?
3. In Seoul, there is a comany that does US Dept of State apostille in 10 days for 160,000 won. Do we have to bite that bullet?
Thanks again for your help and clear writing without imbecilic comments included.

The visa in your passport is meaningless at this point in time (unless you are planning a vacation abroad before Dec. 15 AND it is multi-entry).
Your permitted stay in Korea is governed by your ARC (NOT your visa).
For you this means that you have to be out of Korea (depart) or have an extension completed by the expiry date of your ARC (in your case - Feb 21, 2011.)
As to whether or not immigration will accept an affidavit of authenticity from YOUR embassy in regard to the FBI check (in place of an apostille)- I do NOT have a definitive answer. They USED to but that is PAST TENSE - what they will do AFTER Jan. 1 is anybody's guess.
By apostille I did mean US Dept of State apostille stamp of the document bearing the FBI seal/stamp and signature?
I do NOT know about the "apostille" company nor do I know if it will be accepted. (I never did like "unofficial" 3rd parties getting between me and a government document - I've seen too many shady things happen when that occurs - especially in Asia and the customer is always the one who gets burned when it goes south). From the sound of it, I would suspect that they just mail it off (same as you could do) and charge you a lot for the "postage".

ttompatz,
you da man. thank you for your articulate clarification.
a final, final clarification.

Question:
I am going to China for one week. I depart from Seoul on December 17. My visa is multi-entry. I went to China once already in July, so this will be my second re-entry into Korea on my current E-2, multi-entry visa.
That should be fine, yes?
Cheers, bro. I appreciate your time and input.

Ya, you will be fine.
The reason for the comment about Dec 15 is that after that date a re-entry permit (multi-entry visa) should no longer be required for registered foreigners - before that date a re-entry permit or multi-entry visa MAY be needed to avoid cancellation of your ARC.
