Hello,
First, let me say that while it is dishonorable to simply walk away, my employer has shown himself to be of such low moral character that I cannot trust him to behave properly if I did give notice. I have been told by co-workers that this is the best option out. Unfortunate, as I always prefer to the proverbial 'right thing'. According to game theory though, that will not work in this situation. OK, so.... I may have to stay in Seoul a few days after my Mid. Run. , then go to the airport with my Z zisa for china in hand, giving up my ARC to Immigration, showing them my temporary visa for Korea, since my employer will surely cancel it same day as they realize I'm gone.
My concern here is that I will be leaving under the 6 month airfare trigger (they paid). I am concerned about being detained by Immigration, missing my flight, etc. Article 19 has been mentioned by someone on this forum some time ago. I looked it up and it states that 15 days must have passed before they can even apply to Immigration to have my passport or visa flagged. I have committed no crime, per se, and it is a matter between two private parties. They have ripped me off as well, but that is another story.
My question. Should I be worried about this at all? I have the money to leave the day after payday, but I may not have the Z visa, so I would have to go to the states, then to china.... I would rather stay here and head to china with the Z, but I do not want to give them any time to make trouble for me with Immigration. Thank you.

btw.... is there a grace period for E2 visa cancellations?
I presume my employer would cancel asap, but would I have time to get something else.... I found a temporary visa app online for folks in my situation.

immi won't detain you over a business/personal matter between you and your boss. they only detain you for immigration offenses (overstay visa) |

Don't worry dude, I pulled a runner under the 6 month mark and nothing happened. All you have to do is go to the immigration clerk, you tell them that you quit, hand them your ARC Card and then go on your merry way.
Nothing will happen to you. A lot of people hop on the ferry to Fukuoka and come back to a new job in the same week. |

Even if you employer cancels your visa immediately, you have 10 days (business days, I think, so about two weeks) to exit korea. No application necessary. You dont need a special extension as long as youre out within that time.
Staying in Seoul for a couple days after you run will not be a problem. |

BT,
Thanks. I will not stress over this. I'll take what time I need to do this right and not have to jet same day out of fear. I'm also beginning to think anybody who writes on this site about being detained may be on the other side of the fence... owners/recruiters/employers... to instill fear. It's insane to think someone could trap you with a phone call. |

I wouldn't be surprised if that's the case, because the recruiter might catch flak if the teacher they represented ran.
It also might make you feel better that I hung around Daejeon for over a week and another day in Incheon between the time that I packed up and left my apartment to the time I got to the airport.

Thank you both. Very kind of you both to reply. 10 days, no problem. I'll get my soul back, Seoul.... get it? sorry.
I think the recruiter may have a poison pill in the contract with the employer.... ie if your guy jets, we get half-off, or some such timed pro-rata bargain. Who knows... just a den of jackals.

But will the hagwon have the money to pay you on pay day? Do they always pay on time? What if the hagwon is late in paying? Do you have a plan B? |

I had not considered that. Cheap hostels there no doubt. That is a much better plan. I guess I was in emergency mode and needed a place not requiring a visa of any kind, just my passport. |

cheap place to stay wouldn't be HongKong but it will be easier to get a visa to China.
Other cheap options to sit in while you get a new job (or sit and wait for a new school hiring season to start and gather new documentation) include Thailand or the Philippines.
In Thailand you get 30 days entry on arrival (or you can pop into the Thai embassy in Seoul and get a double entry 60 day visa for free) This can work into 6 months in-country with an extension then simple border run to Laos or Cambodia - rinse and repeat.
The Philippines gives you 21 days on arrival and you can get your first extension for an additional 38 days (total of 59 days) without problem and minimal cost. They will allow you to re-extend (as a tourist) every 2 months for a total of 2 years before you have to leave.

I don't see where going back to the States was mentioned. You can get your Z visa for China in Korea. As a side note, you can get an L tourist visa through the travel agent. It normally takes 4 days. |
