13 years ago, minor in possession of alcohol. Can I get E2?

Ok I know that there has been a lot of discussion about E2s, so I apologize if this has been beaten up before.

13 years I had a minor in possession. I wasn't fingerprinted or any of that stuff, it is a summary offense (less than a misdemeanor) in my state. I paid the fine and moved on.

Now I'm curious if this youthful idiotic moment will mess me up for my E2 Visa?

Any help would be greatly appreciated. I have sent out my CBC already and have signed a contract and I'm planning on making this career change, but now I'm seriously concerned that I'm making big life changes that may not happen bc of this dumb thing.

1) It depends if you have a hit on your CBC.

2) If you do, you can get it expunged.

3) You might get through with something like that anyway.

Cue marsavalanche: you drank when you were 18 years old, how dare you presume to consider teaching children!

LOL. Here we go again...

Immigration is usually very strict with CBCs. If it comes up with anything other than "no records found", you will probably have trouble. If you get through the first time, there is a chance that you might not be able to change jobs in the future because the officer who sees your CBC for a second job might deny it.

Not only that, but most recruiters and schools won't touch you if there is a hit on it.

1) If it is on the CBC am I just done until I get it expunged? I don't know if it will appear. I mean traffic citations don't, parking tickets don't. I think this should just be along those lines.

2) I should be able to get it expunged, I'm going to start that process when I return to my home state in a week or so.

3) I hope this is something that has the ability to be worked through. I mean 13 years ago, obviously I've grown up and matured since then.



** Ah yes the token hatred. YES, I know I messed up. Mkay. I get it. Notice I didn't apply to this 13 years ago. Notice I haven't had ANY subsequent infractions. I have worked my behind off to get far from my stupid impressionable youthful mistakes. I am now a fully functioning and responsible adult that only enjoys 1-2 drinks every season. Anyone that thinks I should be hung is just sorely, sadly, and unfortunately myopic.

If they didn't take your fingerprints, and if you were, in fact, a minor at the time, then it *shouldn't* show up on a background check.

Might as well get the background check, see what comes up, and go from there. Your chances are decent. Besides, a magic 8-ball is as good as anyone on this board at predicting what will come out of a Korean immigration worker's mouth on any given day, even though we all like to pretend that we "know" what they will do/say in a given situation.

Although thanks for letting us know that you are a constantly plastered criminal unsuitable for any future employment whatsoever, let alone being trusted with the precious innocence and superior moral purity of Korean children. It sure makes it a lot easier for all of us never-erring angels to be smug, condescending, and judgmental.

Hey, thanks for the honest response. I'm starting the expungement process soon, but if it does show up, I guess I'll just send it to the recruiter and see what happens from there.

Worse case scenario, I get it expunged (1 month), then get a new CBC (2 months) and hope my recruiter has something for me again in a few months when this is all sorted out. And this would be a terrible scenario, but something I could live with and still would get me there. Plus the extra time to study the language will be beneficial.

If you were under 18, I would think it would not show up.
Over 18, then it likely will.

Order a CBC and you will know.

ANYTHING else in the meantime is nothing more than speculation.

I think it depends on the state as well. Someone I know *cough cough* got one in AZ at the young age of 16, there was a fine with no arrest nor fingerprints same as you stated, and their FBI record came up as no record found.

According to the OP they already sent it out and was just curious about other peoples experience with it.

I think perhaps it depends how you approach telling them about the incident, not to say make it sound less than it is, but you know theres ways of appraoching things, ie - be honest and upfront if it comes up, dont hide, show youve paid your debt to society, etc..

I have an arrest and caution on my crc from 5 years ago, criminal damage, and i got a job and E2 ok. my agency, immigration, korean embassy in london, my prinicipal, my supervisor, everyone has seen it. none of them batted an eyelid...

if you weren't fingerprinted, then it SHOULDN'T be on your CBC. Lucky goose.

Look up your country's laws & state laws if applicable. Look under Disclosure of information for criminal offenses. It should say which felonies are in your juvenile record and which ones aren't. Whatever is in your juvenile is generally sealed so your CBC won't mention it. Serious crimes like arson, assault, robbery, armed robbery, murder, attempted murder, trafficking, weapons charges, etc etc etc. Will show up no matter if its on your juvenile record or not
