If a school doesn't hold up it's end of the contract, am I still obligated to hold to mine?

My school has refused to provide medical insurance or pension, and I've heard they don't pay severance either. I want to leave, and I've got a good job offer, but the new job wants me to start ASAP. Do I still have to give 30 days notice, or can I simply report the school to the labor board and go on my merry way?


For the inevitable flames to come: I did my research, but this is why you don't always trust the teachers that the school tells you to contact- they said the school was great and they were very happy here.

You cannot just go. You still need a release letter? Did you sign a contract? Isn't all that stuff in your contract?

Get a release letter otherwise its not possible to get a new work visa with your new job.

dont do any of those things. The contract is useless so forget it exists if the bastard broke it. dont give him notice tell him you are leaving and demand a LOR. If he says no, tell him you are calling the labour board and immigration and have a phone in your hand. After you get the letter you are ok.

Take it to your new boss and they can trasfer your visa to the new school without u leaving the country.

Oh and the other teachers said it was a good school because the boss probably made them and they were worried about not getting final pay and or airfare/bonus if they said something bad about the school before their final day of work.

What you said is not true.

It could happen if the employer lets it slide and immigration does not pay attention.

However, the most likely scenario is that if she bolts (no notice or Letter of release) when she returns she could face a fine (rare but it happens).
Then when she files for a new E-2, she could face fines again (more likely) and be unable to get the visa processed at all.

Update: I got some great advice by pm, and did some diggiing on my own.

If the school has decided I'm a trouble maker, well they're gonna learn just how much trouble I can be . I'll be contacting the ministry of labour in the morning and I plan on visiting the tax office too, because according to EFL law, I got charged triple what I should pay for taxes.

Does anyone have information on tax offices outside Seoul? Its easy enough to find that info on the main one- but I can't seem to find any others, and it could be very useful for other posters.
