So I've been having some really bad luck with my employer and pay. They've constantly been paying me in two installments and late, even though I told them to stop doing that. They also haven't been paying into my pension at all. So I'm thinking they will probably try to stiff me on my severance, as well as the money they said they'd give me, which was supposed to go into my pension. My employer said she had to wait about a month after my last day to pay my severance and the pension money. I'm not buying it, naturally. How can I force them to pay me everything on my last day? My last day is coming up pretty soon, too. |

You can't force them to pay you on your last day.
They can pay up to 14 days after your last day of work. If they havent paid everything within 14 days, you can file a labor claim for unpaid wages.
You can do that anytime you have unpaid money that is more than 14 days late. It doesnt just apply at the end of a job. If your monthly salary is late, or it was split and partially paid, and it is more than 14 days late - file a labor claim. |

On a related note, I was told that it would take over 3 months to get my security deposit back (each month for my first 6 I paid 100,000 won as deposit). Is that legit? Anyone know? I'm worried that they'll try to skip out on it since I just finished my contract and it's such a long time from now. That being said, I haven't had any negative financial experiences with my school (it's a huge one, and there's no risk of them going bankrupt), but it seems odd that it would take so long (considering return airfare has ALREADY been provided, and severance pay should come within a month). |

I have one month where my boss withheld about 750,000 won from my paycheck to cover medical expenses. I was supposed to get that money back from my health insurance provider, but apparently they never actually signed me up for that, and instead just pocketed the money. My bank book shows exactly how much they deposited. They even told me at the time they would withhold the money since they paid for the bills for me at the time. Now they're saying they never withheld anything and they won't even tell me the name of my health insurance company. So how can I file a labor claim for that money? |

Yes, you can file a labor claim for that 750 000W. They are illegally withheld wages. You weren't told the name of your health insurance company because you never had any health insurance (and, therefore, no pension)......
Also, you need to turn in your boss to the national pension and national health offices for failing to enroll you and pay the premiums. They will be fined for not doing so.
Labor Consultation: 031-345-5000
Health Insurance: 02-390-2000
Pension: 1355
Once, you and your boss have settled your premiums with the health insurance office (and you boss has paid his fines), you should be able to get the 750 000 back (or at least the portion that was covered under your national insurance).
Go to whatever doctor or hospital you visited and gather copies of your receipts from them. You'll need them. It's also highly likely that when you total the receipts, your true medical costs will be less than 750 000.....Dont ask your boss for receipts, you wont get them. Say nothing to your boss and go directly to the places you received treatment for the receipts. |

Another teacher who wasn't getting her pension either contacted the pension office. They said nothing will happen in terms of fines because my boss has us signed up as subcontracted labor, or some bullshit like that. If I enroll in the pension now, I'll have to pay all of the back coverage for the health insurance. My boss is being such a bitch that she said she would rather pay the 2 million won into my pension and health insurance back-pay rather than pay me the 1.1 million won that she would have paid into my pension. I asked her why and she said "I want to honor the contract", with 2 weeks left. If there was a way to screw her over, I would do it, but at this point it looks like the pension office won't do anything.
As for the 750,000, they have plenty of receipts, and they told me the bill was something like 400,000. I have no idea what my health insurance would have covered if I had it though. |

thanks for that helpful information oculis.
my school has also been refusing to give us our required health insurance as well, for 8 months now. if i file a complaint with the national health office, it appears i would have to pay 8-months backlog of insurance, which is a lot of money. i heard somewhere that, if the school refuses to pay your health insurance, they are required to fork over the money that should have gone to insurance to the employee. do you know if this is true? i'm not sure how this works. thanks any advance for any help you could offer. |

Also, you got the severance bonus on the first payday..( not the last).
Iam really sorry, but some of you NETS' are just super super spolied. |

"The Employee shall be covered by medical benefits under the Korean Medical Insurance Union, Government Health Organization. Half of the premium shall be paid by the Employer with the other half
paid by the Employee."
That's a little different from "Go out and buy your own insurance."
And no, severance payments are given for completing the contract, which doesn't happen until after the contract is completed, surprisingly. This would be after the last day.
Question still open, was hoping for an answer from someone that actually has experience with these things. |

ok guys, your frustrations' with the contract violations are understanably heard..However, this is not worth your battle and I'll tell you why:
Unless you are dealing with dependents' ( kids') health care bills on a regular and consistent basis ( 1st year vaccinations and what not); then it is just not that big of a deal..as you are not going to be dealing with huge premuim payouts".
Korea health care is one of the most affordable in the world, look on expats.(or the web), YOU can find afforable monthly plans for under $100.
Iam telling you this for a good reason..don't complain again about this issue. |

dude that still has nothing to do with my question. i'm not asking how to get insurance. to repeat:
