My brother and I were applying to teach just outside of Seoul. We had been working on all of the required paper work for about 5 months. He was denied a work visa because he has a dismissed DUI from 8 years ago. I was wondering if we get the DUI expunged and he has a 100% clear Criminal Background Check would we be able to be reconsidered, or would his name be on some sort of black list? I don't want to go through everything again just to find out the he was denied again.
Finally, I was wondering how in all of the research we did (and it was extensive) was there nothing anywhere about being denied the visa because of a charge that was dismissed? When a charge is dismissed it is even better than a not guilty ruling. According to American Law he should not have even been charged. How can this be a problem? If we try and continue on the teaching in Korea path it is going to be very expensive and take several more months to get his back ground cleared. Is it worth it? Or should we just look for somewhere else to teach? I appreciate any advice. |

That is a good question. I got one about 9 years ago and hope that it will not effect my chances of getting a job in Korea. I have not had any kind of ticket or encounter with the law since. I was 18 and stupid.
I will give this a bump, and hopefully someone can put their personal story on having luck getting a job or not because they had a DUI/DWI. |

Get it expunged and try again, it's worth it. I think there is a good chance you'll get the Visa. If there truly should have been no charges then lawsuit against the police, better for you to get damages, better for me to have the police watch thier step, better for everyone. |

I'm not sure that expungement would do any good. Your brother will have to answer the question "Have you ever been denied a visa?" when he fills out the application for a work visa. If he says yes then the Korean consulate may decide to reject his application. If he says no then they will know he's lying since Korean immigration has a record of him being denied a work visa in the past. |
