Potential Visa Problem?

My contract is almost up at my school and I plan to re-sign for another year. However, I need to get registered with the office of education.

However, in order to get registered in this particular area I need to get my FBI background check apostilled. My wife and I have called several times to check on this. Now, this normally wouldn't be such a big deal, but there is a small problem (maybe?).

I came to Korea before they started enforcing the FBI criminal background checks. I got in with a local background check. It was quicker and basically free for me to do it that way. I have been here ever since and got my F2 2 years ago. About 5 years ago I got a DUI while in college. If I get a background check done, it might show up. When the school goes to register me, will it set off an alarm and they will check with immigration, who will then revoke my visa? Will the office of education "reject"(?) my registration and not let me teach, thus wasting my time getting the check done?

I can start the expungement process in November, but I have heard instances of where it might still show up on a FBI check.

What should I do?

Please don't flame and attack me about DUIs. I understand the severity of it.

On an F2 then the only people who are are the POE.

You may have to change jobs (if you are at a PS) but you can probably stall them for another year.

It is NOT a visa / immigration issue (since you ARE on an F2 but may prevent getting an F5).

I am at a hagwon. So the only people who matter are the hagwon owners? What if they say it's ok, and go to register me at the education office?
The education office can't do anything? Can they say I can't work at the hagwon?

The POE can make employment difficult (but not likely for an F2 even with a DUI). The apostilled FBI check is part and parcel of the new MOE rules (placing the onus on hagwan owners to ensure the quality and qualifications of their non E2 staff. You can certainly stall them for 6 months (the length of time it will take to get your FBI check done from Korea).

Immigration won't do anything to you (F2 holder) over an old DUI but they may give you a hard time when you go looking for your F5 a couple years from now.

You probably have to do the fbi check anywway. Good luck.
