I know the U.S has some weak punishments at times but what would make an appeals court overturn something like this?

Remember, foreigners bringing marijuana into the country get longer sentences.

I posted another link about a rapist who got three years the first time he got caught for rape. After he got out, he raped an 8-year-old.

On the other hand, Cullen Thomas (an American English teacher) recieved 3.5 years in prison for mailing himself marijuana (and considered himself lucky to get 3.5 instead of 10). Pretty sickening considering tests have shown marijuana to make people less violent with no evidence of long term brain damage, even amoung the heaviest users.

Heavy alcohol use has been shown to cause brain damage, and cigarette smoke has even been shown to cause a slight drop in IQ. (This is understandable, as cigarette smoke is filled with poisons.)

The slew of light punishments sex offenders get in Korea alone makes the country non-deserving of OECD membership.

Well, is Korea alone in this matter when it comes to punishing too much for marijuana related crimes when comparing them to worse crimes? The Conservatives in Canada, under Harper, are using their majority to pass a crime bill that has harsher sentences for marijuana growers than pedophiles supposedly. It may have been unintentional. People need to look at all sentences and compare the crimes.

As far as this particular case, it makes South Korea look like Saudi Arabia. We're talking about a 12 year old girl. Regardless if she resisted or not, she is 12 years old. A 20 year old assailant should get real jail time for that. The judge is clearly an old-fashioned misogynist.

The article is very confusing.

They received a call from a friend, who was drunk? And the drunk friend got "A", the victim, drunk too?

Either way, I don't think we're getting all the facts.

First, the way the article describes it, the girl was friends with one of the guys and showed up with him on his motorcycle. Then, she got drunk.

Now, I'M NOT BLAMING THE VICTIM. But, they took this to court, it's very easy to use her behavior as a mitigating factor - remember, this IS Korea and NOT the west.

Second, the article says that the assailants reached an agreement with the victim. Again, Korea, not the West. Reading the article, as an American, I would not be happy with this, but from what's written here, it doesn't seem TOO far out of line. Honestly, I think a lot of you have these grandiose ideas of what kind of punishment sexual assault actually commands back in the US. An assault with mitigating factors, this doesn't seem too far out there.

Despicable crime IMO, but to compare it to the Na Young case is very misleading.

Dude, you expect the government to factor in logic and scientific evidence when making decisions?

More accurately states a lot of the Korean courts' decisions regarding sex crimes.

I just read about another film, an indie production, called "Soom (Breath)" that came out last year. A facility for the disabled saw its director rape three mentally disabled women over ten years in the Jeolla area.

This is appalling...

I love how one of the reasons not to punish the offenders was that they didn't want to be punished...

And the drunk 12 year old could have done a better job of resisting?
