do F-2s (or F-5s) need apostilled CBC for a university job?

With all the crazy new guidelines for teachers and apostilled CBC requirements, I've yet to see a clear, standard answer to one question: are F-2 visa holders required to submit an apostilled CBC from their home country to obtain a university position? I know that E-2s must submit one as an immigration requirement (no matter what level they teach), and anyone working through a job governed by the MOE (i.e. public schools and all hagwons) must submit one, but I'm not clear if there's any such requirement at the university level for F-2 or F-5 visa holders.

I've seen some universities requiring them, but not many, and I'm guessing it's just their prerogative to do so, but that's nothing but my best guess.

As far as I can tell your assumptions are correct. Not legally required by MOE for university instructors, but many universities are asking for them anyway. And the universities are fully within their rights to do so.

I understand the frustration with this, considering how annoying, expensive, and time consuming it can be to obtain one of these checks when you're already in Korea (especially if you're American!), but what can you do? It seems like if you even bring up the possibility of not providing a CBC it's going to look like you have something to hide.

The universities aren't exactly having trouble finding applicants, so if you don't want to get a CBC surely someone else will.

Thank you, r122925, for confirming my hunches. I feel the same - it's a nuisance, but a necessary evil at this point, and not worth risking not getting hired for a job you want because you don't have one.

You are right it isn't an MOE requirement.

I would ask the university one question though:
"Do you require criminal background checks from Korean employees?"

If the answer is no, why the hell should you submit a check.

Universities have been told to increase their numbers of foreign staff so it is important that we don't agree to lesser conditions in the misguided belief that there is a shortage of university jobs. Yes there is a shortage of great university jobs, but the ordinary ones in the country are still plentiful.

I agree with you in theory 100%. But if you actually want to get the job then this approach probably isn't the best idea.

In the eyes of the university a person who asks this sort of question is a trouble maker who doesn't like to do what he is told and may or may not have something on his CBC that he doesn't want us to see.

If you were extremely qualified, and I mean head and shoulders above the other applicants, you may be able to get away with it. But if there are 10 other people with similar education and experience as you who are all willing to submit a CBC the univeristy will simply move on to the next candidate.

I guess it all depends on how badly you want/need the job.

For me it boils down to:

I want a good job + they want a CBC = they get a CBC

No point in quibbling about it much more than that, unless, like the previous poster says, you can afford to thumb your nose at the job requirements (and who knows that the gov't won't implement a nationwide standard soon anyways and make this discussion moot).

Our university has no CBC requirement for new hires of any visa.

They hadn't even heard about such a thing being required in Korea until I mentioned it to my boss (speaking of public schools).

My friend's uni's English department just changed, and they are requiring him to submit his apostilled cbc to renew. He's been married to a Korean woman for years, and has none of these documents, as they only told him about it a couple of days ago. He's been there for years, so, if they don't renew him, that would be sh**ty.

Also illegal, they need to give four months notice of non renewal. They can get around this with sponsored visas by not renewing their visas but for F2, F4, F5, F6 and Korean citizens this doesn't wash. He should contact the MOE office not the labour board.

Some universities are trying to hagwonise (is that a word) their conditions for foreign new hires, but the government has ordered universities to take on more foreign staff.

If you have a Masters and one and a half years experience (unfortunately hagwons, and companies don't count) then you should be able to set your conditions.

Seoul National University advertised 22 weeks vacation and 12 hours a week for around 3 including the housing allowance. Why would you take less to work at a lesser university.

Does your friend have an F-5 visa ? If so I've heard a Korean check is enough ?? Especially if he's been here for years ?!

I've just heard of this new thing wherein if you work at an employer as a contract employee for over two years, you become a de facto regular employee and cannot be arbitrarily dismissed, particularly for something like that that is a new university policy that he was not informed of and not the law. He should start getting the documents they want together ASAP and talk with them about them giving him some time to do it since it's a new policy, etc., but also be ready to go to the labor board if they won't back down. But I'm guessing since it's a new policy, and it's not a matter of law (unis are NOT required by law to request apostilled diplomas or CBCs) that there is a pretty good chance they'll try to work with him on it.

This depends on job title, I think.

I always thought that immigration ran checks before giving F2's and F5's, but it was just the impression I got.

F-5 yes, F-2 no (one of the reasons why the F-5 takes so much longer to process)
