|
|
my friend was fired from his job after only two months on the job. He has been in Korea over 6 years, but only has only been working 2 months on this e-2 visa. The school that fired him doesn't want to give him an LOR for whatever reason. He has already found a new job. What are his options? Can he do a visa run? Can he force his old school to give him an LOR?
He is FREAKING OUT as he has his wife and child with him, and can't afford to return to the states.
thank you in advance for your help. |

They have no legal obligation to give away the visa they sponsored. It's not his visa, it's the school's visa.
He needs to:
Get new documents
Switch to a D-10
Find a new job
Apply for a new E2
Apparently people have been able to get E2 in country these days without visa-running. If we are to believe the braggers on this site that is. |

fastest, easiest option would be a double visa run.
1st trip out (hand in the ARC) and back to clear his current visa. (his expense).
Apply for a new visa and when the VIN is ready, do another run to get the new visa. (new employer's expense).
Alternatively, he can go through the labor board to get his termination in writing (a legal requirement) and then just apply for a transfer to the new employer. (won't be quick)
His family are fine on their current F3s while he gets it sorted out.

one more thing, will he have to supply a new set of documents (CRC, etc...) for a new visa? |

Possibly.
Best bet is to contact immigration (IN PERSON). They are NOT his enemy and will (unless he gets a lazy git at the counter that day) do everything they can do to legally assist in the transition of a terminated employee.
Failing that, double run and process a new visa (may need new documents, may not since he was only out of Korea for a brief time).

In a case like this would the accompanying wife and child have to do visa runs as well? |

In my personal case, no. I did a visa run (E2-E7) while my wife and daughter stayed on their F3s.
I suspect that your case may be similar.
Again, go to immigration. Tell them what happened and they may be able to assist you (call your boss to confirm termination of employment - he is, as your sponsor, required by law to report the change in your employment status to them).
All the rest of this (beyond the confirmation that you can do a double run to cancel and then obtain a new visa) is purely speculation based on previous experiences. The final decision is at the discretion of the guy sitting at the counter when you go there (run, transfer, D10, etc).
