She then went and called the recruiter, who I suspect is the real one behind this (maybe not), and told me to wait. She got back to me, and started crying about me not trusting her to give me my severance pay.

She's been nice to you. Obviously, your poor boss is shocked that you don't believe and trust her words. Don't make your nice boss cry again, OP.

You do not have to complete exactly 12 months to get severance.
You could do 10 months and get severance. My co-worker just did this. It all depends on what you and your employer agree to.
A school can fire a teacher for almost any reason as long as they give 30 days notice and pay you for it. So if you don't agree to the end date that your school wants, they could just give you a termination letter 30 days prior to the day they want to fire you.
Going to the labor board to file a complaint will probably guarantee that you won't get your severance.
This is so retarded! Anyone with any common sense would play nice with the director and take the end of contract 6 days earlier. Then collect severance and all the other benefits.
Why anyone would fight this makes no sense. But then again, 80% of the disputes I see at the schools I have worked at would never apply to me. I only fight the big battles that I can win. Why fight over small potatoes? |

As the op, I would like to make several things clear.
1. Regardless of the severance issue, I am being cheated. It may be no big deal to some of you, but that�s one months rent money to me
2. My boss wanted me to come back for a year, and when I asked about extending for a month she refused, and said one year or nothing
3. I never lost students, and there were no financial problems the entire time I was there.
4. She would not do anything in writing
5. I have two places that want my services in March, and they sure as hell aren�t hagwons. Therefore I am not worried about her badmouthing me. What� she going to do? say I am terrible because she tried to cheat me, and I can prove it.
6. I am going to see what happens with severance, and then fight it later. I have three years to do that. |

After all the horror stories you hear about hagwon owners cheating people out of money, your advice is to trust the owner? If the owner's school is doing well financially then why does she need to pay him after she leaves the country? That's very strange and it seems she knows the law about the severance pay. Furthermore, she doesn't want to do anything in writing, that's another red flag. I would definitely continue to work the 6 days so that she has to pay me that severance.
On the other hand, if the OP takes her word, he could potentially be out of 2.6 million won for the month. That's not chump change. |
