The original post is rather vague. The posts after indicate that they are working at the same school for 6 months after completing one year.
Perhaps you are thinking of a scenario where the original poster only did 4 months, and then would return to finish 2 months after a vacation.
Is that why you think I misread it? I agree, I was going on the premise 6 months were completed, but I still hold the same position for different reasons.
1. It would make more sense to hire a new teacher (for reasons I will mention in 2).
2. If you are going to argue that the contract should be the same, then it should be the same right? That means the typical clause that states that the teacher should teach 6 months before taking vacation time.
OOPS!!!! We are back to that 6 month restriction
I know you are gritting your teeth now, but to take vacation time you have to give your employer, on an E2 or F visa, enough work to financially afford giving an employee time off. An F visa holder could easily be giving the school less hours than an E2, making this point even stronger. So, as I mentioned in 1, it would be a bad business decision to hire or rehire a teacher only to give them holiday time off after only working 4 months. This means instead of 2 vacation periods the employer has to manage giving 3 periods throughout a year's span.
3. As an additional point, the school might need a teacher for camps. This is where the school can make a lot of of its money. I don't know the original poster's schedule last winter, but if they were busy teaching then, then why wouldn't they think it would be same this time around?
Did they work 4 months and get vacation time? That's possible, but in that case they were agreeing to come back to teach 8 more months, not just the 2 in this hypothetical (or situation if this is what the original poster is faced with).
4. As a bonus, only seen on Dave's, we have no idea about a replacement teacher. If I were the original poster, I would be asking about when a replacement teacher would be coming. If you were going to leave after 1 year, but the school asked you to stay 6 months, what makes you think they will magically get a replacement? The responsibility isn't yours to get one, but if you are the teacher teaching until one comes, you need to think it out. |
