Quit - E2 to D10 before or after my trip out...

I have to go home because my father is undergoing serious surgery. I didn't want to quit my job but my employer decided to deny me the time off because I would need two extra days vacation (which obviously I asked for only as unpaid) on top of what I have remaining to be away for the week. He said that he couldn't allow me extra time off. I told the boss I would have no choice but to quit since I absolutely have to go home for this. Anyway, he still said no. So, I handed in my notice and will finish working there on the Friday before flying out on the Saturday. I'm coming back the week later all being well and will seek new employment then.

My question is, can I just leave the airport as usual and then return with my arc card and get the D10 with a LOR when I'm back or am I supposed to have the D10 before going as soon as I'm done at my current job?

With finishing work then leaving right away there isn't a free day to visit immigration but I'm concerned that if my E2 is cancelled by my boss and I haven't applied for a D10 then I won't be able to transfer. Or that I'll get stuck at immigration on the way back in and have to come in on a tourist visa or something?

IF your return is within 14 days of the termination of your employment it shouldn't matter. Just keep your ARC when you go through passport control at the airport.

When you return go to your local immigration office and apply for your D10.

P.S. Your boss has nothing to do with applying for a d-10 (other than writing you a letter of release).

Its hard to believe that he'd rather fork out for a new employee than let you go for one week.

Not hard to believe at all. Some of these guys make Hitler look reasonable.

Won't the OP need an LOR from his nice boss before applying for the D10?
