Making it as short as possible:
I have an F6 and have been working at this kindergarten for 10 months.
The agency pays me, not the kindergarten and i am taxed 3/3%.
When i applied for the job they asked me if i could teach for more than a year and i said yes but we initially signed a one year contract which ends end of may.
Issue:
Agency emailed me yesterday saying this:
Hi, the school may reduce the number of classes from march so would you like our help in finding a new job?
They didnt explain anything or fire me properly, nor have they given me a one month notice.
My questions are:
do labor laws apply to me (i think i am a private contractor)?
What is your advice for me TTompaz?
Should i fight for my rights?
Does the kindergarten have any responsibilities with me?
can they fire me like that?
P.S ive been a good teacher and the school has been happy with me so this is not a matter of me not being suitable for the job.

Agency? Who?
What does your contract say? Are you paid by the class, or a fixed salary? If it's the former, this seems like a very nice offer to help you pick up some extra cash since your main job won't be paying out as much. |

The labor law just refers to "worker," not employee or contractor. You're 10 months in, they need to give you a months notice. |

1) Yes, labor laws apply.
2) talk to a labor office. File a complaint if you feel justified. IF you seek advice then they will take the easy way out and send you away. IF you file then they have to act.
3) The best you will get is 30 days notice or 30 days pay.
4) No but they did. See #3.
5) File a complaint and MOVE on. You will lose more by trying to hold on to the past then you will by taking something new for March 2.

Ttompaz, when you say file a complaint. Do you mean for me to file it against the kindergarten or the agency who hires me?
The reason why im trying to fight for this is because this job is one ina million: Pay is 2.3 and work hours are from 10:30 to 2:30.

Whomever your actual employer is (the guys who pay you / the people who you have a contract with) ... but again...
If the job is gone the job is gone - all you can force is 30 days pay or 30 days notice.

One in a million!!! So they were supplying housing, health, pension? |

Man do I feel like an idiot. I turned down a job for the same hours (admittedly a little later in the day) and no benefits last week. They initially offered 2.5, when I said no they increased it to 2.7. I still declined. I assume as they didn't come back with another offer that they must have found some other F visa holder to fill the role.
Are F visa holders really taking these roles, particularly those without benefits, for such low ball amounts? |

Well i admit that schools probably would prefer f visa holders since there is very little paperwork in hiring us.
Today after i officially got fired and was on my way back home, i dropped by a school and was hired after a quick interview ( i havent decided if i ll take the job yet).
However, F visa holders are not to be seen as a threat bcuz: How many of us are there? And how many job openings you see daily? |

You're deluding yourself. I finish work at 1h30 every day, and I get housing and pension. |
