I am hoping to get some advice. (I have called the labor board but they told me to get legal council, which I am also going to do to.)

I was due to start work today for a hagwon. Due to emergencies in my family I cannot work there. I told my recruiter this on Friday, and he was supposed to pass on the message for me. As I have no contact number with the school.

I haven't signed a contract yet with them so where do I stand legally? Can they sue me for damages as they are threatening? Can they also cancel my E2 visa? They have absolutely no information of mine, not even my ARC number. But the recruiter is calling me lots of colourful names and now is saying he will cancel my visa. (My visa incidentally is not with this hagwon, but with a previous school that I parted from amicably and with a LOR.)

I wanted to get a D-10 so I could go home and come back to work later. I don't want this mess to jeopardise that.

Sorry if this is a ramble, but its been a stressful few hours.

The recruiter is simply blowing smoke up your ass because they just lost out on the commission AND now they look bad in the eyes of the employer (they couldn't fill the vacancy).

No signed contract means no obligation. The recruiter can do NOTHING to you or about you. They cannot cancel your visa. They cannot affect your status in Korea.

Get your D10 and change recruiters.

Don't forget to name and shame the SOB (the person - not just the agency).

The recruiter is just pissed they are gonna miss out on the $1000 commission. They are threatening you, hoping you will cave and reconsider walking away. If you are in Korea and looking for a new job, I'd reccomend joining FB groups for the area you want to live. You can avoid recruiters that way, and possibly get a better gig as well

C'mon now Missty, have some sense and think about it for a second. Of course they can't cancel your visa. A recruitment agency is just a private company. They have no power whatsoever on immigration issues, or anything else for that matter. Don't waste your money on legal counsel either. You absolutely don't need it. You didn't sign anything.

Go to immigration with your letter of release. Hand over your fee, and they'll change you to a D10. That process does take 3 weeks though, so I don't know whether that'll be any good for you if you're heading home for an emergency situation as you say.

Good advice people. Your recruiter is a peon that had his jung wounded. Screw him.
