Hello guys! I had a E-7 visa and I had been working in Korea for 2 and a half years as a software engineer. My job contract was for 3 years and my visa supposed to be finished in 28th of February, 2015.
In July of this year I finished my contract with my employer and changed my job. I started to work at a new company from August. My new boss asked me to bring him a copy of my passport and alien registration card and I brought. He said he registered everything, something like pension and 4 types of insurance. But he did not informed immigration office, and I didn't know that immigration office should be informed. My old employer cancelled my E-7 visa, and I was informed by mail to come to immigration office. However, because I lived in an apartment which was given by my old employer I had to change my address and letter of notification came to my old address. So, I didn't get any letter from immigration office and around October 12 my new boss was called by immigration office and was told that my visa had been expired in September 17th and had to leave Korea.
On airport I got departed stamp on my passport and came home to Uzbekistan. After 2-3 days I went to embassy of Korea in Uzbekistan and asked whether I have any restrictions to enter into Korea or not. I was told that I do not have any restrictions or time limits and I can prepare all documents to get a visa. However, I really feel that my new employer is not eager to invite me to Korea again. It is almost one month I am waiting my visa and have not got anything even my new boss is saying that he is doing his best to get E-7 visa for me.
So my question is, if my new employer could not get E-7 visa for me, what kind of options do I have? Can I get D-10 visa from Uzbekistan and go to Korea to search a job? Should I do a tourist visa? If I do a tourist visa, can I change it to to E-7 visa in Korea after I join to some company? Any help and suggestions are appreciated. Thank you for reading my long message. |

Your realistic options would be to either wait for the current employer to meet the requirements to hire you on an E7 and get a new visa confirmation number or try again with a new employer.
Unless you have a PhD the odds of meeting the requirements for a D10 are slim.
Flying in as a tourist and job hunting almost always ends in troubles and a cheap visa run is not an option with your passport.

Oh thank you ttompatz. I did my master's degree in Korea. Do you think I still have a small chance to get D-10 visa?
I have another question, if a Korean company invites a foreign professional, should that company pay some fee or tax to the government? If yes, what that fee or tax is called in Korean and how much does it cost? |

Won't make any difference for a D10. It was not from a top 200 ranked uni.
No, they don't need to pay but they do need to prove that they cannot hire a Korean to do the job. Until they get clearance from the Ministry of Employment and Labor they can't hire a foreigner (probably the reason your last employer didn't get your immigration problem taken care of before you were deported).

Actually that is not altogether true. The following statement comes directly from the most recent Foreigner Sojourn Guide dated 2013.12.01, pg 98 "who graduated from a Korean junior college or higher within the past three years..."
So technically, if the OPs degree is within the three year span for successfully completing a degree, then he or she would be eligible to apply for the D10.
Also, the number of E7 type employees is limited to 20% UNLESS there is reason for the MOE&L to grant such a visa based on the nature of the employment. There are also some rules related to this particular area regarding salary to ensure that foreign workers are not unfairly treated. So it is highly unlikely that the OPs employment situation had much of anything to do with why he or she is having these current problems. IMO
In all likelihood, the OPs employer dropped the ball on taking care of business with the immigration office and that is why they are in the situation they are in right now. |
