“The charge of homicide resulting from bodily injury carries a sentence ranging from three to five years, but if the crime is committed against a family member the maximum increases to seven years and if committed against a family member a second time then the maximum increases by half and can reach 10 years and six months. Factor weighing in favor of a heavy punishment are if the crime is committed more than once, if the victim is a family member or ancestor, or if the crime is particularly heinous.”

So maybe he could be released after three years since he is not a reoffender. Most likely he will be deported and banned from re-entering Korea after serving his sentence. He definitely needs a good lawyer who knows the system.

If you're over the limit, bye, bye VISA - F visa people may get off more lightly.

I've already seen " how does drinking affect your teaching? " on the EPIK renewal form.

Crazy how we're thought of here. This might not help.

I'm curious as to how others parse the foreigner in question's comment about the now deceased "had already sexually assaulted" someone.

And why has the guy been charged. If the ajushie was drunk and being a douche in Itaewon maybe he had a second altercation and got his injuries then. Maybe he fell. .... And if the Itaewon ajoshie was very drunk, and fallen, he might have (deliberately or otherwise) fused the two events in his mind. Blood money, hatred of foreigners, humiliation at losing a tussle with a younger foreign man, etc. Or the Westerner is a thug, perhaps with a history of violent behavior. Something in between?

He may or may not have that 'evidence', but if the cops have any 'evidence' that he punched the guy...he is going to jail for murder.
This is a terrible turn of events.
My sympathies to both of their families.

Whether or not he has evidence of that is probably immaterial. If the fellow really died, I imagine he's looking at something between manslaughter (if his account is 100% true) and murder (if it isn't). "I killed the guy, but I saw him grope a woman earlier," is not the kind of logic that is going to exonerate him.

I didn't think it would exonerate him, but at least maybe earn him a little bit of leniency in sentencing. Unless like I was saying he doesn't have any evidence of any sexual assault, then he's just slandering a dead guy and likely to get hit with all the books.
