Mix: "Fact" in legal parlance doesn't mean the same thing as it does in common usage. "Fact" for the lawyerly types is "alleged crime". |

I still dont see how imprisonment is possible for libel unless the DA is pressured into charging him. Imprisonment can not he possible in a civil suit. |

Interesting how even telling the truth about someone or something is punishable. I guess with that mindset, it explains why Asiana tried to sue over harm to their "reputation" when they in fact screwed up and the press simply tried to talk about it.

If you are sued and lose, you can be prevented from leaving Korea until you pay the amount required by the court.

Note that she was not allowed to leave Korea, it didn't say that she was imprisoned. She may have been free to seek other employment and live on her own, just that she couldn't leave the country until she made restitution.
So, I doubt that libel would get someone imprisoned. You'd have to do something really big against someone really powerful. Everyone else will just settle for money. |

Libel absolutely can get you jail time, if the victim doesn't agree to a simple pay off. Furthermore in Korea if you can't pay your fines, you can be jailed at a rate of 50k/day until it's paid off. |

Each and every one of those "others who were present at the scene" will then have to answer to the court (assuming they're summoned and respond to the summons) why they did not contact the police regarding the groping. The prosecutor likely will not have a difficult time negating the character assassination of the dead man.

Either way, does the actual truth of an allegation have any bearing on the punishment? It seems to have a lesser punishment but is still punishable. In the quote, they use "fact" and "false fact", so what is the distinction in lawyer speak? So "false fact" means falsely alleged?
The western, or at least the American definition of libel seems to be along the lines of "the act of publishing a false statement that causes people to have a bad opinion of someone." So if the guy was indeed a known groper, there is no libel (under a western understanding of the term, I'm guessing).
In the case of the teacher who reported her bosses dirty activities, did it make no difference in the case if the dirty activities reported were true? |
