What should a person do if they are not being paid the same amount shown on their contract? It was already brought it up with the employer and they just ignored it.

If F visa, waLK OFF the job. Hit him/her in the pocket book.


If E visa, labour board.

It doesn't matter what your visa, give the owner a signed letter indicating that they have to pay you X amount of outstanding money immediately. When they don't go to the labour board. Do not walk off the job. How stupid.
When the labour board calls your boss to tell them they have to pay the difference and then the boss fires, you go after them for unfair dismissal.

Walking off the job would be an idiot move.

Alongtheway is right. Especially for F visa holders who are in the country and can wait 2-3 years for it to play out in the court.

It doesn't take 2-3 years.

Labor Board takes one month and then if they still haven't paid up it will take another 1-2 months to go through small claims court.

If F visa, why not walk? Of course I would give warning first.

If someone has the freedom to change jobs, why work for someone who has shown to be dishonest?

It would depend on the situation. If on an F-VISA and 300,000 won in the drainer, I would show up for work and tell the boss I quit just after the bell rings for the first class to begin. I have done this exact thing a long time ago. I walked out the door with a smile on my face. There was nobody free to cover my class. Of course, I already had another job lined up the day I walked out. I wish all visa holders had more freedom to change jobs with their visas. It would cut out a lot of the garbage in the industry.

Because you are denying yourself an opportunity for more money. I just explained it, do you need a picture? If you go to the labour board to get the pay and they call your company, then the boss fires you for going to the labour board you can go back for even more money, potentially the rest of your contract for unfair dismissal. If you walk right away you give up that opportunity. Make them fire you, you get more.

Chances are that it will be resolved when the LB investigates but if the school owner is really stubborn and doesn't mind having a record, he could stall payment for quite a while, and you might need to go again to the court to get the money automatically taken from the bank account of the school/owner. But things don't usually go that far.

The lawsuit for wrongful dismissal will take about a year.
