Okay, so my director recently said that he can't pay my bonus, because he can't afford two foreign teachers. So, when I leave, I won't be replaced. Then, on Monday, it came out that not only is he replacing me, but expects me to praise the school to my replacement.
Anyway, he's still not paying the bonus, so I went to the labour board. I figured it's a pretty open and shut case, so no problem. However, in order for them to make him pay anything, I have to file a complaint 14 days after my contract is over, and have to be in the country.
But, what about the fact that my visa says I have to leave three days after my contract finishes, and that I have stuff to do back at home? Too bad.
Can I do it from home? No.
Can I have a friend do it for me? No.
The labour board guy said sorry, but the laws were made for Koreans not for foreigners. So I asked what's to make any boss ever pay anything to an employee who leaves the country? He said, "nothing, I guess..."
Nice.
(Perhaps there should be a moratorium on hiring/screwing us until there are laws in place for us?)
Anyway, anybody have any advice here?
I'm thinking of threatening to print up signs in Korean with his name, face, and true story of the school to post all around the neighbourhood, but I don't know if the cops will come after me. |

Yes go to immgration and get an extension. Then file your paper work with the LB. You can also list someone as your representative at that point if you leave the country.

Get an extension on your visa from Immigration. It's not hard to do, especially if you explain your situation to them.
Also, has your hogwon been paying taxes? If they think you can get away without paying your severance, probably not. The next time you discuss your severance with him, let him know that you are planning on contacting the Tax Office to get a record of taxes you've paid in Korea. You know, to make sure you're square with Revenue Canada and all that.
He's probably more scared of the Tax Office than the Labor Board, so that might get him off his ass. |

Actually when you file an official appeal/complaint with the labor board as a complaint and it's accepted (ie, officially investigated) you are legally extended to stay in the country for the investigation period, but it's still best to extend your visa on your own. |

I would get it extended on my own too. Cover all your bases. Since when does the right hand know what the left hand is doing in Korea?
Or any country for that matter. |

I think I addressed both of these points in my OP. I have stuff to do back at home. Back in school in September, and don't have a summer to waste chasing money that's rightfully mine. And no, a representative isn't allowed. I have to be here in the flesh, or it's dismissed. |

Wrong and please read.
Get a 2 week extension and file your complaint. Pick a representative and let the LB know at that time (can't pick a rep before your complaint, but can after). Than go home! I think thats what I said below.

I have neither the ability (not being a LB rep) nor the inclination to argue about this. I just had a 45 minute meeting with the labour board rep near my house, and he told me if I'm not here to "negotiate" in person, then there's nothing I can do. If that's wrong, then I've gotten incorrect information from the man himself.
p.s. When you say I'm wrong, please back it up. You've said what to do, but not why it will work in the face of what I've said. Perhaps your tip is correct, but it comes across as being what you assume will work. If you've done it personally, then I stand corrected.
p.p.s. "Negotiate"?????....

I do occasional work for the LB and my wife works for them. I'd suggest you call the LB translation 'hotline' (forget the number). Don't tell them you've talked to anyone at the LB yet and ask them for help. They are generally more helpful at first. Once your complaint is entered you can have a rep. The guy you talked with, avoid him, either lazy or dense is my guess.

honestly though, chances are the "officer" you talked to was just incorrect. Lots of room to manouver in the aplication of the laws here.  |

Just checked with the wife. IF you go the route I said she said the most agents won't be overly helpful to your rep. She thinks the agent you talked to is major lazy. She said to call the call center and either they will call on your behalf or will try to explain things to an agent so that they'll call your boss. That solves about 90% of problems.

KN, even if you really can't stay for even one more day past your visa period, get the extension anyway and tell him you got it because you're planning to fight for your bonus.
Even if it's only a bluff, it's better than nothing. |

Just a quick 2 cents on the labor board
The election day holiday, which was touted as a national holiday.
I was told I would have to work that day so...........
I contacted the labor board to ask if it was in fact a national holiday.
The 'gentleman ' I talked to said yes it is a national holiday....BUT.... it is only for Koreans who are going to vote and they are supposed to go back to work immediately following their voting.
I asked is this a national holiday like Chusok? 'Yes but only for Koreans'
I said 'if it is a national holiday then everybody should have it off....to only say Koreans get it off is silly '
His reply was 'You are silly '
Some of the people working for the labor board are either stupid, biased or misinformed or all of the above.
I ended up hanging up laughing at the absudity of the situation. He really got angry with me when I started laughing and started name calling. I just felt this was one more ludicrous situation......only in Korea.  |
