I posted about the visa run a friend of mine was going to do last week. I went with him and, well it didn't go too well. The embassy was closed on Monday for old peoples day in Japan. He has been trying to register for a week or so but Sperling has not replied so I am posting his mail here...

I was wondering if someone here could help me...

- My contract says a round trip ticket to process visa will be provided.

I went to Osaka on Sunday (they had already booked the ticket) so I had to pay for a hotel room myself. On Monday the embassy was closed. I returned to Seoul on the Monday evening and was told then I would have to go the following day (Tuesday) to get the visa processed. They asked me if I could pay for the ticket. I said I couldnt as I had no money.

I got the visa on the Tuesday.

My total expenses were over 360.000 won for hotel, buses,trains, food, visa issuance fee etc
Now the school want me to pay at least half of the second fare.

I feel this is unfair as I will then be paying over 500,000 for the whole process. The school also says I wont get the 6,000 yen visa fee back as I dont have the receipt. What are my rights if any and what should I do?

I tried to change the ticket on the Monday, but was told I couldnt. I rang the school but couldnt get through. I sent an email and was told to stay there (osaka). Apparently they changed my flight at 6pm, however I had already gone through customs at this stage (flight was at 7pm).

- Also on my contract it says "The instructors salary will be paid monthly on the regular day for payment of instructors salaries"

I started working on the 6th September. I will get paid on October 10th, only for September. Then on November 10th, I will get paid for October. Can I challenge this so I can get paid for the full month on the 6th or the 10th of October. Or is the contract worded to cover that?

If it was them that arranged for you to go on the wrong day in the first place, then of course what they are doing is unfair. Unfortunately, there is not much you can do about it I'm afraid. Sure it's unfair, but there isn't really a clear violation of the law as they can argue that it's your fault (of course it isn't, but what can you do?). The only thing you can do is walk really. That would mean not being able to work in Korea for a year, though. You could try to push them a bit, but I doubt you'd get very far.

A lot of schools pay a few days after the end of the month. If all the other teachers get paid on the 10th for the previous month also, then that's exactly what the contract says. You signed a contract that defined payday as "the regular day for payment of instructors salaries", but you did not ask what day that was for that particular school before you signed. I'm afraid that one was your fault.
