Sometime I'll try to sit down and write more.
But for now, here's some short news. I went into work on Friday and they told me they were able to interview and hire a new teacher. Which, I am basically happy about. This teacher has asked to start right away, but it sounds like they've agreed that I will work through this coming Wednesday (Feb 2) and then I'm out.
About the release letter. While it doesn't sound like the boss wants to do bad business, they said one thing that still needs to be confirmed. They said that what they would do is just do the things on their end and that come Wednesday we essentially don't need to do anything else together, meaning they would process the visa with the new teacher the same way they did with me and that would take care of everything. They said that on the day they go to immigration to process the visa with the new teacher they would simply inform immigration that I have agreed to end employment with them, and that I wouldn't need to be together with them at immigration, implying this would be a legitimate way of successfully ending my obligation with them and giving me one month to find a new job (living on my own in a goshiwon) in order to continue the E-2 visa with another employer.
Question. Somebody on this thread (I think Derrek) said that in order for an agreement (non-fire) release to take effect that the former employer and the exiting employee MUST be at immigration together. Couldn't the same former employer just go down to immigration themselves and process the same paperwork, which would actuate the same letter of release? I would imagine, but not experienced about, that really the only important thing would be for the boss to show up at immigration and then the teacher wouldn't show up until he's with his new boss. Would this be a letter of release of less than favorable conditions, for sure? Straight answers only please. I see myself doing some time in esl and want to make this right. |

A couple points.
Immigration doesnt issue a release letter, your boss does. Its just a simple letter as exampled above. Maybe things will be cool with your local immigration branch but I think it would be a sensible precaution to get one in hand anyway.
Your situation might be different but I think you have 14 days to hang around after termination of an E2, not a month. I'd ask for clarification on that. |

right, boss issues letter of release, immigration accepts and processes it. i think my boss intends to hand me one.
the question is, the boss seems to imply that they will just do things standard simply when they process the visa for the new teacher, at which time they will also inform immigration that I no longer work for them. the implication i got was come Wednesday (Feb 2) I finish my last day and Thur I no longer show up for work, they start with the new teacher, short while after that they make their own trip to immi (apparently me not there) and it's all taken care of. the question is, is this ok? anyone have any problems with it in the past? seemed like a few posters stated the old teacher and boss MUST be together at immi to be considered as a positive LoR agreement.
and my point was, that it at least sounds like it makes fine sense even if the boss and old teacher go at seperate times on their own accounts, so i need to ask others on that here.
also, so it's 14 days, not a month? hmmmm, i wonder why different people have different times. also, is it 14 days from the day the boss actually walks in to immi office, or is it 14 days from the 'date' that the boss informs immi officers the old teacher officially finished? like i said i would like to get this all precise. |
