Teacher Fired...what are her options?

New Developments:

The owner decided today that she can work just one more week. She can stay in the apartment for one more week after that but then she has to move out.

He also decided that since she didn't finish her contract, he will not be providing her with airfare home. So in two weeks, she'll be homeless, jobless and have no way to get home. If the owner terminates the contract without a good reason doesn't he have to pay the airfare?

airfare into korea is not protected by labor law. only the return airfare is covered.
however, as roundtrip air has become a standard in this industry, the labor board has been following the rule of thumb that 6months=one way air fare.
following this guideline, your friend wil probably loose the airfare.

the contract states 2 months notice in the case of termination, but labor law says no notice is necessary, prior to working six months.
labor law usually over-rules contract law.
the labor board will probably not be able to help, but give them a try anyway.
your friend should file a claim if he/she feels unjustly terminated.

one more thing.
if th school has less than 5 full time employees, they are exempt from paying airfare altogether according to labor law.

What if the school officially has 3 teachers but unofficially has 12?

I was sworn at in Korean on a daily basis. The kids do it because they know they can get away with it.
