catching up on the daily news this morning, and in a real reality stylee, (sorry RR, but there are plenty of other stories to link to today...) spotted this this nugget in the chosun ilbo...
shocking judgement to be handed down imho, surely the fact that the woman didn't resist can't be construed as grounds that she consented to sex!? she was unconscious! argh!

This reminds me of a story I posted. Some people were saying that the girl I slept with was unconscious even though I wrote nothing of the sort.
Here is what the newstory says.

It was '...Sora seemed half there and half not...', which set the blood hounds foaming at the mouth. I assure you that she was not unconscious. The blood hounds also use double think to ignore the following paragraph '...Ready to leave, sora escorted me to the ground floor of the building. I asked if she really couldn't remember anything. "of course I remember", she said, kissing me on the cheek'.
You also have to remember that her friends were right there. Its not as if I could have done anything wrong. |

The immediate following will get this thread deleted for the same reason it was deleted in the first place. I dont see why I should go over this again with you. The girl wasnt unconscious. She gave consent. That particular time was the second time I had sex with her that day. The next day she remembered and was pleased with it. What more do you want? |

a) You didn't ask her what she remembered. I didn't ignore this paragraph, but it sounds to me as if she was saving face.
b) "It's not as if I could have done anything wrong?" Can you explain the logic behind this? It sounds like you're saying that her friends wouldn't have let you do anything wrong, which is probably not the case, given that drunken people watching each other have sex do occasionally cross moral boundaries. |

it wasn't my intention when posting to dredge all that up again.
and yes, it doesn't actually say unconscious, but when i read 'incapacitated by drink' i think thats mighty close to, if not the same as, 'unconscious'.
anyway, thats not the point. the judgement appears to rest on the fact that because she didn't resist, she consented. this is not the same thing. if i am capacitated, unable to react, then my mate can say 'do you mind if i take your car? have all your money? burn your house down?' i can't consent because i'm incapacitated, but because i don't resist his wishes its ok for him to do so?
non-consensual sex is rape. and i can't believe that the judge can't see that and that i'm having this same dave's conversation again... |

But it also says she acts completely normally when she is drunk. How is someone to determine consent when they seem completely normal? does any amount of alcohol drinking mean that a woman cannot give consent? What about a man? |
