i'm hoping someone can help me with this problme and re-assure me that my school are incorrect...
i'm at a GEPIK elementary, due to finish in August after a happy, (relatively!) stress-free year where everyone was happy with my work. my school were keen for me to re-new, intially offering some good incentives, but for a variety of reasons (returning to uni, spending some quality time with my family amongst others), i decided to politely decline.
ok, number 1; i want to take my 7 working-days vacation at the end of august, and to leave on saturday 20 august (we had agreed that the 22 August would be unpaid), to allow me time to get home, get to a very good friend's wedding and see my parents before they leave on their own vacation.
the second point here is that school pay day is on the 25th. i would be leaving before my pay day (4 working days before) and therefore the school intially agreed to pay me before i left, giving me time to transfer the money home.
thirdly, my visa ends on 22 August. my airline (asiana) don't have flights on that day, (at least that whats i told the school), so i must leave on the 20, or extend the visa for a few days. extending the visa is a pain in the neck for both me and the school, as they are well aware of.
so, here's where my extreeeeeeeeeeeemely bureaucratic school administrator comes in. she says
1. - you can't leave korea before the end of the contract. you can't take your holiday on the 20 august. its against the law.
2. - we won't pay you before your pay day. its against the law.
3. - we will allow you to leave on the 31 august. no sooner, no later. its the law.
(i'm emailing efl-law on this too for some advice btw.)
this can't surely be true?
people leave the country before the end of there contract all the time! i went to china in january for god's sake!
the school can surely make a payment before the payday!
my visa is up! why extend it for 10 days?!
any advice, previous experiences would be very very gratefully recieved...

I had no problem negotiating an early end to my contract--I'll be leaving August 11th though my contract runs to August 23rd. I exchanged teaching two hours of English camp once a month, for no pay, in return for being allowed to leave early with no penalty (still receiving my 1-year bonus, etc.).
I have to say that I did get lucky, though, in that a co-teacher did the actual negotiation for me after I'd been discussing my concerns with her a bit. If she hadn't gotten what I consider a very good deal I might be upset she did it behind my back, so to speak, but it's worked out and I'm glad. |

I'm assuming(forget the assumptions reply) you went to them first and told them your story about Asiana airlines not flying on that day. I'm a tourism major and it doesn't take one to know your lying through your teeth. You lied to them first so if they lie to you about the law what do you expect?
Your negotiating skills are lacking to say the least. I'm sorry, I may not have been able to do any better as you are asking for a nice favor/deal. Who cares about the law? They probably don't, why would you unless you were ripped-off? But, you weren't! Yes, they could do what they say is against the law(because we know it ain't), but you lied first! Go tell them your sorry for lying and try again. |

it has this handy 'international' feature, kinda shows you what are flights are available ON WHAT DAYS to OTHER COUNTIRES.
so sit down, make yourself comfortable, and have a look and see how many flights there are to Heathrow (thats in England by the way) on the 22 august...
(little hint, there aren't any)
its fine though, you can apologise to me later. next time you post, try to be a tad more helpful, ok? |

I make typos all the time but this grated on my nerves:

Anyway...
The school isn't right about you leaving early, but I know a lot of the principals and bureaucrats are worried about the program being audited (as it is in it's first year) so they are "jumpy" about doing things without someone else's approval.
As for the 7 days working vacation are you talking about the 7 of 14 days (7-winter and 7-summer) or the extra 7 working days "bonus" for re-signing (sounds like you are talking about the summer holidays based on an August 20 leaving date.) This shouldn't be a problem. Though again they want you around until the end. Korean bosses don't like it when they feel like you are "calling the shots".
But remember in the end, they hold your money and they know you are keen to leave. They hold more cards than you do. And YOU are the one asking for a favour.
(Based on my complaints about grammar and the spelling of certain words can anyone tell what country I hail from?)  |

My point was the typo (problme) I could overlook.
In my neck of the woods we would say "is" and "doesn't", not "are" and "don't". As I am not an ESL teacher (well not to any great degree anyway) I wouldn't be pompous enough to assume that this might not be appropriate in "British" English where they do strange things with plural and singular when it comes to group nouns...
(Though my feeling, without looking, would be it isn't common usage anywhere...) |

You mentioned NOTHING about Heathrow in your original post and thats what I responded to. You made it sound like in your original post that you told them a "story"/fib/lie. Regardless, you ought to appreciate my reply and suggestion. Your original tactics at trying to get what you want failed. So, why not try again? Or, are you a quitter like many Koreans? |

update:
with thanks to those who replied and pm'ed me regarding my situation and who offered advice. my school, after i showed them relevant pages from the ministry of labour, immigration and of education, have seen sense. i am 'permitted' to leave when i wish, get paid when i wish and take my vacation when i wish, as per my rights under Korean law.
