Not according to the Korean Labour Board. They informed GEPIK that the deposit (900,000 over 3 months) was illegal and that they could not do it...if they tried to do it the labour board was prepared to step in.
ANY forced withholding of salary is illegal....if they were to ask you for a cash deposit up front before you started work then it would be okay.....it is not okay for them to deduct it from your check!
It is the deducting from your pay that is illegal...not the deposit in itself...just the illegal way they go about it.
As to your other comments:
Salary when you work specific hours a month....anything outside of those hours is overtime....extra pay...anyone who works more than the contracted hours for nothing is throwing away money.
In the contract they expect you to be in a classroom 30 hours a week(the agreed upon hours) then they also expect 5 hours preparation time=35+ meetings and workshops....=38+ hours a week. That is far outside of the agreed upon 30 hours a week...and by most labour standards would be construed as overtime. If they want people at the school 40 hours a week they should stipulate that in the contract. Not tell someone 30 and then tack on extra time to suit their needs and wants.
This is why I always say that the contract should be quite specific concerning hours and responsabilities. If I agree to a 30 hour workweek then that is all I expect to work for the salary...anything outside of that is overtime. |
