She has kept the baby.

Defense attorney Randy Richards contends the felony conviction of the girl violates the constitutional equal protection conviction.

Two 14-yearolds having sex may be charged only with a Class B misdemeanor and for 16- and 17-year-olds, intercourse is illegal only if one participant is 10 years older than the other, Richards said.

Utah still has a law that makes adultery and fornication a class B misdemeanor, but it has not been enforced in 50 years.

Richards asked the Utah Court of Appeals to dismiss Juvenile Court Judge Michael Andrus' conviction of his client or reduce the charge.

The case was reported to authorities by a doctor during the girl's pregnancy, Richards said.

Richards worries that any violation of her probation, which could extend another seven years, could result in her having her child taken away from her.

"For now she has a juvenile felony record," he said.

He expects a decision from the appeals panel within a few months.

A law that was probably written to protect minors from being sexually abused by adults is now being used to convict minors who "sexually abuse" each other. What good can come of this?

Par for the course ... all too absurd.

Nonsense legislation needed to keep the growing # of law school graduates busy.

If it ain't a crime today, fear not: it will be tomorrow. Keep building those private prisons for profit.

what happenned to, like playing soccer, and talking about the other gender?
*beep* the legalistics of this case.....wtf is going on here? why do kids have to have sex????

Because pop culture makes them think that they are supposed to.

Honestly, I say that it is perfectly acceptable to blame MTV.

I don't know much about this case in particular.. but the words UTAH jump out over and over and over in my head as I read it.

Utah.. Mormonism.. Mormonish.. Utah.. fornification as I'm sure they see it.

I'm sure this has a lot more to do with Utah State Law and breaking rules from the Book of Mormonism. Kind of an interesting court case.

Throughout the other 49 states.. underage teenage pregnancy is sadly commonplace.. interesting to see a court case with Mormon Utah and how it deals with this legally.. very interesting. Hope the case gets more media attention and stays in the public eye a bit.

That could have something to do with it. I found these quotations from Mormon leaders about how sexual sin is second only to murder in Mormon doctrine-

Self-love ( did this "dirty" little word make it past the "language" censor? ) breeds gays? Hmmmmm ... it wasn't so long ago conventional "wisdom" had it as causing insanity ... or even blindness Shocked Geee ... i wonder who mighta cooked this one up?

Actually, y'know, now that i come to think of it, IT can also lead to taking a nap, or going to the fridge for a glass of water, or maybe just reading a book or listening to music. An all too absurd & fallacious attempt to definitively link self arousal & people suddenly becoming gay.

As a side note, the classic Hebrew for SIN apparently meant to literally "spill one's seed on the ground".

Sure, kids of that age ( in the modern west ) should not be sexually active, but sometimes they are. Let's not forget either, many places in the world youths have long been married off by 12.

Ought it be a crime? Only if statist society is increasingly in favour of advocating ridiculous legislation.

Judging from stories like this, apparently it is.
