I'm sure you read about the shop owners in the U.S. who were busted by Mircofag for offering modded machines. Of course this is simply window dressing. Nevertheless...

They were arrested because they were doing wholesale piracy, specifically selling copied games for cash. The DMCA violation for circumventing the copyprotection is pretty low on the list of the charges and more to show intent that they really wanted to push copied games. 77 games were sold with the Xbox they modded, for example.

It was an investigation done by the U.S. Immigration and Customs Enforcement after receiving a complaint from the Entertainment Software Alliance in May of 2005.

The store itself is pretty upscale, though the webpage that pimped out the modded consoles was pulled.

Here's my question:

You can buy a modded Xbox with, say, 70+ games on Ebay and no one bats an eye. What's the catch?

No, but I've got a good story for you.

About 2 years ago I purchased a modded Xbox on Ebay that included many games for $135. What a steal! Right? I got an email a few days later saying they had received my money and the unit had shipped, etc. etc. It never came. But I DID get an email from Ebay saying that the seller was under investigation for fraud and that many people had been scammed by the same outfit, blah blah blah.

So, these deals DO exist, but whether or not they're legit, only the buyer ultimately knows.
