Leave Korea within five days of end of contract?

What is this clause that so many hagwon contracts in Korea seem to have? Is it a legal requirement for teachers to leave within five days of their contract ending or just something that the hagwons have invented to make it more difficult for teachers to deal with any problems they may have? Can anyone confirm or deny the legality of this clause?

It is an immigration law to limit over stay of foreign workers when their work visa expires.

It is not a ploy, a trick, a cheat or any thing of the kind..it is an immigration law regarding visas for foreign nationals. Just like laws pertaining to visas for foreign nationals in other nations....


All it means is you must leave the country within 5 days after the expiry of your visa unless you get an extension. If you want to stay longer, get an extension or leave and come back (i.e. Japan rounder).

Simple no?

You must leave by the expiry date on your alien registration card. Failure to do so will result in hassle & fines.

With a reasonable excuse you can get an extension at your local immigration office for a small fee.

Yes, I know this is true, and in many countries so I'm not trying to attack Korea for it. But why is it accepted?

If you can get a three (or even six) month tourist visa when you first arrive, only five days at the end of a contract seems excessively short. What do they think you'll do if you stay longer? There must be many people who finish a year with money to burn and who would like the chance to travel around the country -something that's almost impossible on a hagwon schedule.

I would suggest that this be extended to at least a month. It would certainly benefit a lot of English teachers -whether they have to fight for their final paycheck or search for a new job.

My main question is: What reason do the Korean authorities have for wanting foreigners to leave Korea within a week?

The hagwon is legally responsible for you while you are here on your E-2. You rape, they are liable. So, if you are no longer an employee, they do not want to take a chance...

If you're here on a six-month visa, it ends after six months. If you're here on a one-year work visa, it ends after one year. Simple as that. If they gave you a 13-month visa then it would simply be that.

You can get extensions. It's not hard from what I've heard. I think for up to a month. Don't think it has anything to do with screwing over foreigners.

You do NOT have to leave Korea within 5 days of the end of your contract. This is misleading.

What you have to do is:
A) leave Korea by the date indicated on your ARC. You may re-enter anytime as a tourist or other visa.
or
b) Before the date indicated on your ARC, go to immigration and apply for a "change of sojourn" to change your status from E-2 Status (Teaching Foreign Languages) to C-3 Status (Short-term Visitors) and your reason is tourism. Cost is 50k won.

When a foreigner desires to cease his/her present activity and concentrate on an altogether new activity which falls outside those permitted by his/her status of sojourn, he/she should apply for and obtain this permission(article 24-1).

I was about 13 days over the expiry date on my alien card(that was Jan 2004) when I left Korea before. I didn't have anything bad happen to me, all that happened was I had to wait an extra 15 minutes or so while they clucked over it a bit between each other. Then they just took my card and said adios, the girl was smiling about it. Remarkably lenient considering what some other countries might do to you.

No leeway after the end of the ARC? not that 5 day thing someone mentioned? If so I have to teach until 5pm and then leave the country on the same day unless I get that extension. Sucky.

Depends on your country of origin and your reason for staying... typically 30 days to 6 months.

As far as I know, if immigration law hasn't changed, a foreign national
must leave the country on the day the E2 visa expires upon completion
of the contract. For those who have terminated their contracts prematurely
they have 14 days to depart. Cool

It's easy. You just go to the immigration office and tell them you want to change your visa, when it expires so you can travel around the country and see things you didn't have a chance to see on a tourist visa.

They will give you an extension. It's very easy and will probably cost you a mere 10000won.

I don't know how long, I presume it is down to the discretion of the immigration officer. I'm sure they'll have no issues with giving you a month to travel around whatever your nationality.
