Do your worst guys... it doesn't seem too bad... OT is poor but its completely optional, 2.0m a month is ample anyway...



2. CONDITIONS OF EMPOLYMENT

a) The Employee will act in an appropriately professional manner and be responsible for conducting professional English Language classes. Also, teacher will be educated for the school��s teaching program.

b) The Employee will be required to work for regularly scheduled hours from Monday to Friday. Each teaching hour in excess of 30 hours a week (120 hours a month) - incldes OJT, Level Test and other teaching duties - is considered as overtime.

* Here, teaching hour represents actual class time , Level Test and OJT sessions.
(Class preparation time is not part of teaching hour.)


c) The Employee is required to go through an orientation and training program before starting Employment. The Employee will be expected to be present at work at least 1hour hours before his or her first class and be present for an average of one hour of preparation time a day.

d) Classes and teaching hours are scheduled at the institute's sole discretion.

3. SERVICES PROVIDED BY THE EMPLOYER
a) PAYMENT & TAX
The Employer will pay a monthly salary of W 2,000,000 for regularly scheduled hours which we mentioned on the page 2 worked. Payment of salary commences from the first day of orientation.(Total salary = W 2,000,000 - Income tax : 3.3%)

b) The Employer may ask the Employee to work over time (the Employee has an option to refuse and will not be forced). If the Employee chooses to do overtime, the Employer will pay for the overtime at the rate of 18,000 won per hour.

c) Salary: 1��th day ~ last day of each month -> The employee salary will be pail on the 10th of next month.
.

d) Tax for income will be deducted from the salary according to the Korean tax law.


4. HOUSING

a) The Employer will provide the Employee a Single housing (includes refrigerator, washing machine, TV and bed ) and the housing will be provided at no cost to the Employee with the exception of maintenance, phone bills, and internet and cable line if the Employee desires the services.

b) A two-person apartment/house will be provided for a couple, if both are teaching at the Institute..

5. AIRFARE

a). INSTITUTION shall provide round-trip ticket. In the event that the INSTRUCTOR willfully leaves the INSTITUTION before completion of his/her contract, the INSTITUTION is not responsible for the return airfare. If the INSTRUCTOR willfully leaves the INSTITUTION before 6 months, the INSTRUCTOR must pay back the initial airfare and INSTITUTION may deduct the said airfare from the INSTRUCTOR's last pay.

6. MEDICAL INSURANCE
a) If the Employee wishes to purchase health insurance, the half of the insurance premium will be paid by the Employee and the other half by the Employer.

b) Health Insurance will be provided within one or two months of registering as an authorized foreigner at the request of the Employee.

7. SEVERANCE PAY
Upon completion of this contract, the Employer will pay one month's salary as a severance payment to the Employee. This payment will be made at the time of completion of the contract period.

8. VACATION
a) The Employee may have 10-working days as paid vacation per year, which will be organized by the institute. Days in which the Employee does not regularly work i.e., Saturdays, Sundays and National Holidays are not to be considered as part of the vacation period.
a) Employee's paid sick leave during the Term of Employment shall not exceed three (3) calendar days. ( A doctor's invoice with the diagnosis and prognosis is required to be paid for sick days.)

10. RENEWAL & TERMINATION OF CONTRACT
a). RENEWAL
The Employee must give the Employer a written 60-day notice before renewal or non-renewal of the Employee's current contract.
Both the Employer and the Employee reserve the option to renew the contract.
b) TERMINATION OF CONTRACT
Both parties will give at least a written 30-day notice prior to the termination date of the contract.
The Employer retains the right to terminate the contract immediately if:

* The Employee is unable to discharge the responsibilities and duties designated by each branch��s management team. ( meet the conditions such as being late for class on a continuous basis, continuous failure to keep regularly scheduledclass hours and repeated absences from classes and OJT without a valid reason , etc )
*.The Employee teaches a private class outside of the school.
*. The Employee participates in any type of criminal activity of corruption of public morals which violates the laws of the Republic of South Korea.
If, for any reason, the contract is terminated before the full completion of the contract period:
The Employee will not qualify for benefits such as severance pay and the airfares.

The Employee will be wholly responsible for any maintenance and phone bills
remaining for the duration of their housing lease.
Within 14-days the Employee is required to sign a notice of termination and accompany the employer to the Korean Immigration office to notify the Korean Immigration office of the termination.


11. DUTY OF EMPLOYEE
This contract is an agreement between the school and said teacher. The Employee will not share imformation outside of the school or other teachers at school about the contract such as salary, working hours etc.

12. GOVERNING LAW & JURISDICTION
1. This contract is governed by the low of the Republic of Korea.
2. This contract is made final and firm unless any material modification or amendment to this contract is executed with the full knowledge and consent of the undersigned and incorporated into this contract.

Looks reasonable, though I'm sure Grotto will grumble about the slightly low overtime rate.

two questions though:

what's OJT? it's mentioned as part of your duties.
how long is orientation?

Par for the course newbie contract but I too would like to know what OJT is and how long the orientation is to be?

These however are very minor point that should not be reason enough to turn down the job...unless OJT means something like Obey Jesus totally... Laughing

Then..I would worry.

It looks like a decent newbie contract. If you haven't already, check with current and previous teachers to make sure they've gotten everything they've been promised, and it looks like you've found a decent job.

2(d) and 8(a) make me slightly uneasy...I'd get those clarified.

2(d) Make sure that those hours are scheduled within the set time period you indicated in your second post.


8(a) The vacation time should be consecutive. Ask about that

What is OJT?


You are aware that you already broke this contract (see 11) where you agree not to reveal information about the contract, right? Laughing

Oh well, can't be helped now. But that to me is always a red flag. Why would the employer insist on that, unless the offered salary is below the salary the other schools in his area are offering?

1. I believe "OJT" means "On the Job Training" It could refer to the so-called "teacher training" you are to receive OR it could also mean the classes YOU will be required to provide to the other KT's or FT's.

2. I thought health insurance became mandatory. Expect them to try to talk you out of it and even if you do opt for it you have to wait 1 to 2 months? It sounds like they want to take a look at you before committing to the extra expense. Then, remember, after two months you will have to pay premiums starting from the day you landed in Korea with the E-2. Since you will already be in the hole for back premiums (and so will your employer), this could be used to get you to decline to sign up for the insurance.

3. Did I miss the part about "pension?" No, I'm not talking about severance. I'm talking about the pension program that employees should be enrolled in.

4. They will decide when and how many vacation days can be taken consecutively, according to how it is written. In other words, it could become a situation where you get A vacation day every couple of weeks. Don't assume you will get a week at a time. They will decide.

5. You have to pay for a full year's maintenance and phone costs even if you leave early? I guess I misread that part - must have.

6. You didn't break the confidentiality clause because you haven't signed it and the school isn't mentioned. It may be a situation where different employees are paid different amounts based on experience, education, gullibility, stupidity, ethnicity and/or nationality. So, they want to keep it under wraps. Or, they just want to keep their information close-hold. No problem in that.

1. I'm pretty sure that OJT stands for On the Job Training, so they want to pay him for his time during any training they may give him. That's a good thing.

2. Worth paying attention to, a lot of bosses will try to drag their feet on health insurance if not weasel out of it completely.

3. True, but the OP is from the UK, so he won't get it back. He's probably better off not paying it if he can get away with it.

4. Good point, this has happened to me. Find out from the current/previous teachers how vacation is handled.

5. The wording could be interpreted that way, I suppose, but I think it's extremely unlikely that that's what they meant. They probably just mean that he is responsible for utilities while he lives there.

6. Yep, no argument here.

3. Good point. The Brits (and some others) get messed over when it comes to pension.

5. You are probably correct. I guess I did a double take when I saw the part about duration of the housing lease.

As I looked at it again, how many classes per week make up the 30 "teaching" hours? How long are the classes? The OP, apparently, will not be paid for breaks between classes (which could be a problem if forced to work a split shift).

Maybe it was mentioned and I just overlooked it, but is the Korean or English version of the contract the one that is applicable in the event of a disagreement or arbitration?

There is a time delay mentioned for the health insurance because generally you can't sign up for the National Health Insurance until after you go to Immigration and get your ARC. Not to worry though, your payments will be back dated to your arrival. So, get your ARC and sign up fast.

OT is poor is not a good sign. You want OT. It's good money.

Don't worry about vacation. Although being at the sole discretion of them is kind of bad even though it usually is. Just have that eliminated from that contract. Just come to an understanding. That means that 6 of your ten days are during the 2 big holidays and the school may or may not be shut down. Don't worry about that. You can always take a holiday if you're intent on it. Korean has a lot of national holidays so you can plan around that if you want to go to southern Asia.

I disagree, overtime at a hogwon is generally a bad deal. If you want to work longer to make more money, you are better off just doing privates for double what most hogwons pay their full time teachers per teaching hour, or for overtime.

You want it to be optional so you can refuse it.
