For starters:

No...get it down to 20-25 per week. Never mind about the monthly hours (120) cause they'll be figuring out pay in 1-week blocks. 25,000 isn't bad but if this is their initial offer on OT amount I'd try to up it to 35,000 and bargain it so you end up w/ 30,000! Very Happy

ok... so you want to work in a Kindy... that is cool if you like preschool...
BUT... 40 minute classes and 120 hours... = 160 classes per month.

Clarify how many CLASSES you are expected to work.... 2 million for 120 classes is OK... 2 million for 160 classes just plain SUCKS.... been there, done that (1st year here).

Don't make the same mistake I did...

What is a teaching hour.... is a 40 minute class = 1 teaching hour? or
60 contact minutes=1 teaching hour? .....
50 minutes and 10 minute break = 1 teaching hour...
40 minutes and 5 minute break = .75 teaching hour...
GET CLARIFICATION first and put it in your contract....

A) Talk to other theachers at the school. Thay are your best source of information about what the conditions are really like at the school and can put the contract in perspective with real examples.

B) If you do not like certain parts of the contracts or have worries....ask other teachers at the school about these clauses and about working there.

C) If you find an area unclear and that worried you, just talk with the school about it now.

As for the hours vs class thing.

Each class is 40 minutes and you have to teach 30 hours per week. Now that could mean 45 classes per week (this is with no breaks so that wont happen) or an avg of 9 classes per day.

It could also mean 30 classes per week (6 per day) as they might mean one teaching hour is actually a 40 minute class. Just clear that one up. It is not necessarily a cheat here and it does not necessarily mean that you will have to teach 160 classes a month!
Best of luck.

This contract fits most of my recommended BARE MINIMUM conditions that I think a newbie should be looking for and insisting on at a kiddie hogwon:

2.0 million for 120 teaching hours/mo
free non-shared apartment
roundtrip airfare from and to the nearest international airport to your home
block shift (no more than 8 hours between your daily start and finish time, get that in writing)
health insurance, 50% of premium paid by you, 50% by employer
Monday-Friday schedule, NO SATURDAYS
2 weeks vacation
all national holidays off (no need to make them up)
any overtime is optional, paid at the rate of 120% of your standard hourly pay

The day is a little long, with 9-6pm meaning a 9 hour day. Teaching kids that could get tiresome.

Overtime is well paid, but does not seem to be optional. Still, you are guaranteed that it won't be outside of your block shift.

A few minor points to consider:

* Don't kid yourself, you aren't getting 14 days of paid vacation, you're getting ten (5 working days per week). If you look at it as 14 days of paid vacation, you're counting weekends as vacation time.

* It looks like the boss is open to you signing off on privates, working at a second location. If you're willing to work for it, you might have a chance to make extra money elsewhere.

* There's no such thing as a free lunch...

Quote:
But lunch will be provided during class days.

This probably means that you will be expected to eat lunch with/serve lunch to the kindergarteners. PRO: That's one meal you won't have to pay for five days a week. CONS: You don't really get a break for lunch, and you will have little choice but to eat whatever they serve for lunch.

* Airfare issues:

Quote:
The Institute shall pay for an economy one-way ticket to Korea from the nearest International airport to the Employees home. A return ticket will be provided back to the nearest International airport to the Employees home upon completion of the Employees 1-year contract. In case the Employee fails to complete the contract by his or her own fault/reason, the Employee shall pay back to the Institute the total amount of the airfare.

The good news: Two one-way tickets are better than one round trip, because this means you can schedule some travel around Asia. Round trip returns usually can't be extended for longer than a year after the departure date.

The bad news: If anything goes wrong at any time during the contract period you'll have to pay him back for your airfare. In the first six months, this is fairly reasonable. On, say, the tenth month, it becomes quite a bit less reasonable. Ask for a six month time limit on this reimbursement clause.

More bad news: If you want to stay in Korea after your contract ends, it sounds like you get nothing. Ask for cash equivalent for your return ticket.

Overall, the contract sounds pretty decent.

As always, of course, talk to some of those 14 foreign teachers before you sign anything.

Also check with your school if you have to feed the children on your lunch hr. I had to and I hated it because I lost some much preparation time. Also put in a clause that says that overtime is completely optional and that you only have to do it if you want to.

And 30 hrs of actual teaching a week is lot. A new teacher shouldn't really do more 25 hours. 1 extra hour a day doesn't sound like much but when you lose an hour to prepare it. Trust me, been there, done that.

CONTRACT
_________________________________________
This EMPLOYMENT AGREEMENT is an employment contract between

(Passport Number: ) to be referred to as the Instructor and Bambini Language Institute (Bambini Edu-Center) to be referred to as the Institute from this point forth. Both parties agree as follows:
CONDITIONS OF EMPLOYMENT

The Instructor's job description shall consist primarily of the following:

**The following below should be "duties."

3) Duties

a) The worker will work from ** p.m. until ** p.m. Mondady through Friday, unless agreed otherwise.
b) The worker will teach a maximum of 100 classes per month.
c) One class is equal to 40 minutes of teaching English to Korean
Students.
d) The worker will adequately prepare for classes, by appearing 30 minutes early before the first class every working day.
e ) The worker will obide by Korean laws

**Your there to teach English and English only! 8,7,6, need to go. That's my take on it though.

Article 1. EMPLOYMENT OF INSTRUCTOR

The Institute wants to employ the Instructor as an English teacher for the Institute and the Instructor agrees to work for the Institute as an English teacher.

Article 2. PERIOD OF EMPLOYMENT & Working Hours (Working Hours don't belong in Article 2!)

The period of the contract is one year beginning from the date of the Instructor's first working day at the Institute in Korea. At this contact, it starts and expires . And the working hours are 9:00-6:00, Monday through Friday.

**This Period of Employment clause was poorly written. Hagwon owners know it's illegal for workers to work without an E2 Visa, but they still force workers to work on an E2 Visa.

The worker will not work for the employer until Korean Immigration has issued an E2 Visa to the worker. After the worker has been issued an E2 Visa from Korean Immigration, the period of employment will begin on ________/________/________ and end on ______/________/________. Furthermore, the the worker will work for the employer for a period not exceeding one year.

Article 3. SALARY, SEVERANCE PAYMENT AND WORKING HOURS

**This is another poorly written clause!

A monthly salary of Won will be paid for within 30 teaching hours per week (Monday through Friday). Payment shall be made once a month at the end of the day. In no event shall the Instructor wait longer than 31 calendar days to receive his/her monthly salary. For the sincere accomplishment(completion) of the contract for one year, the institute will pay for 100% severance payment. Korean Income tax will be deducted from the salary of the Instructor each month according to the Korean tax law. The tax shall be deducted from the salary of the Instructor each month. No other deduction of any type whatsoever shall be deducted from Instructor's salary without prior written consent from Instructor.

The worker's guaranteed monthly salary will be ***********KOREAN WON for a maximum of 100 classes worked per month throughout the contract period. Furthermore, the worker will be paid the last working day of every month throughout the contract period. Under no circumstances will the worker be paid late throughout the contract period.

I would go with classes per month. They can't say, "Oh you work an hour here, and an hour there!

(Make sure you start at the beginning of this upcomming month. That way you can get paid on the last working day of that month.)

??) Korean Pension Fund (4.5%)

The employer will deduct ****** Korean WON from the worker's monthly salary, and contribute it towards the Korean Pension Fund throughout the contract period.

??) Monthly Withholding Tax

The employer will deduct ********** Korean WON as a monthly withholding tax throughout the contract period.

??) Severance payment

Upon completion of the worker's contract, severance pay in the amount of one months salary (**********Korean Won) will be paid to the worker on the last working day. Under no circumstance will this severance pay be withheld from the worker.

Article 4. OVER-TIME PAY

If the Instructor teaches more than 30 hours a week, he/she will be paid 25,000 Won per class hour.

**Another poorly written clause!

??) Overtime Hours of Employment

The worker may choose to work overtime classes once 100 classes have been worked. Furthermore, the employer will not force or pressure the worker to work overtime classes. The worker may choose to work overtime classes at the following rate of 25,000 Korean Won per overtime class. Both parties will mutually consent before the worker works overtime classes. One class is equal to 40 minutes of teaching English to Korean Students

Article 5. POLICES

The following policies have been established to assist Instructors in the expected performance of their duties. The Institute will have the right to dismiss the Instructor for clear and frequent neglect of duties under this agreement.

9. The Instructor will set a good positive example of him/herself and his/her Institute at all times. Furthermore, the Instructor will follow the directions of his/her director.

10. The Instructor is required to attend all staff meetings as requested by the director. If the Instructor has to be absent, he/she must inform the director or asst. director prior to the meeting.

11. The Instructor will follow set class schedule and will not dismiss class, cancel class, or start class late without the approval of the Institute director.

12. The Instructor shall prepare teaching materials for each class before and will be honest and diligent in teaching students in all classes. The Institute agrees to furnish all curricula, textbooks and other teaching materials.

**How long do they want you to come in before class?

13. The Instructor will prepare and administer a mid-term and final examination for each class he/she teaches. The results from each class will be evaluated by the Instructor and reported in writing to the director.

**This shall be a negatory. Insist that it's removed. You will be working outside your working hours if you sign off on this one. Get rid of it while you can.....

14. The Instructor is required to interview new students and evaluate their placement level.

**Howdy here..... This is the director's job. Insist that this clause is erased.

15. The Instructor is required to dress in a professional manner. Professional dress and grooming in the work place are essential to maintain the desired reputation of the Institute. The Institute shall establish guidelines for professional dress.

**The guidelines should be set in stone before the contract is signed!

16. The Instructor agrees NOT to partake in the following activities since they may damage the reputation of the Institute:

1. Conducting class while under the influence of alcohol, while smoking, or under the influence of illegal drugs.
2. Make sexual advances towards, or enter into relationships with students or employees of the Institute.
3. Conducting any PRIVATE classes or accepting any funds outside of the Institute should be arranged and discussed with the director of the institute.

**Red flag..... Insist that this is removed!

4. Borrowing or lending of funds to students or conducting any sales of items to students.

17. Any damages that are the direct result of negligence on the behalf of the Instructor, either at the Institute or residence, will be paid for by the Instructor. Furthermore the Instructor will be held liable under Korean Law.

18. If the Instructor seeks release from the contract for cultural differences, homesickness or personal problems, he/she will report to the Institute and agrees to work until the replacement Instructor is positioned within 4-6weeks.

**30 days is needed. You leave after 30 days!

19. If the Instructor fails to conduct him/herself in a professional manner, resulting in damage the image of the Institute, the Institute has the right to terminate this contract, but must provide at least a two-week notice to the Instructor. And, if the Institute violates the contract, the Instructor also has the right to terminate the agreement, but a two-week notice must be provided as well.

**This is a terrible termination clause.

The employer shall not dismiss, lay off, terminate, or suspend the worker without "justifiable reasons." In addition, the employer will not dismiss the worker during a period of temporary interruption of work for medical treatment of an occupational injury or disease and within 30 days thereafter. Justifiable reasons shall be defined as neglicting one's "duties" as outlined in clause

Article 6. BENEFITS

A. Housing

Meals are not provided. But lunch will be provided during class days. The institute will provide one single bedroom and living room apartment with accomodations such as a bed, a TV, an airconditioner, a wahing machine etc. The instructor can request general accomodations, and the institute will provide them upon requests.

**The housing clause is also poorly written. It's important to have something about search and seizures.

The employer will provide the worker single housing, and rent. The worker is responsible for paying utility bills, including electricity, water, gas, cable, internet and telephone. Any and all damage caused by worker will be paid by worker. The employer will provide furnitures and other appliances. They will include an air conditioner, bed, bedding, sheets, desk, table, dining set, TV, washing machine, clothes rack, pots, pans, dishes, phone, fridge, and a stove. In return for a furnished apartment, the worker agrees to respect and care for the apartment, with the exception of normal repairs, in a respectful manner. Any outstanding bills belonging to the worker will be the sole responsibility of the worker. In accordance with Korean Constitutional Law, the worker's place of residence shall be free from intrusion. In case of of search and seizure in the worker's residence, a warrant issued by a judge upon request by a prosecuter has to be presented. The search shall be conducted by the proper authorities.

B. Medical Insurance

The Institute shall pay half of the monthly premium for the Instructor's medical insurance. Half of the medical insurance shall be deducted from the Instructor's monthly salary.

**This clause is also poorly written. It's a little to vague. I could be wrong on the clause below though. If I am, others will correct me.

The employer will enroll the worker in the Korean National Healthcare Insurance Plan. The worker will be physically presented with his medical insurance card on __________/__________/__________. The sum of 3 months contribution, ********** Korean Won, will be prepaid by 3 month intervals (the contribution payment duty is retroactive to the day he was registered for his residence in Korea) except for the permanent foreign resident. Responsibility to pay the contribution is upon the employer. Furthermore, the employer will deduct 2.24% ( ********** Korean Won) from the worker's monthly salary and pay it to the National Health Insurance Corporation on a monthly basis throughout the contract period.

C. Airfare

**In case the Employee fails to complete the contract by his or her own fault/reason, the Employee shall pay back to the Institute the total amount of the airfare. Insist that this clause is thrown out! Allot of employers fire workers for illegal reasons, and withhold the airfare money from their monthly pay.

??) The worker may not work at another location other than that specified on the application for the work visa unless permission is granted by Korean Immigration authorities.

1. Holidays

About 12-15 Korean national holidays and designated 2-week vacation (1 week for summer vacation and 1 week for winter vacation) are observed each year.

Article 7. GOVERNING LAW AND JURISDICTION

Both parties have read the above conditions and agree to the terms in good faith and will attempt to resolve any dispute in a reasonable manner. Any dispute arising in connection with this contract shall be resolved in a Korean court of law according to Korean Regulations and Codes.

Insist that the below is deleted.

The Employee agrees that any release from an employment contract for the purpose of teaching elsewhere in Korea cannot be approved without written permission by the Institute and then must be approved by the Korean Immigration Authorities, and that only rarely are such requests permitted. This is an important issue, and the Instructor must realize that Civil Action under Korean Law may be followed.

The document clause may be a good idea to throw in.....

??) Documents

a) A sponsorship letter of guarantee will be attached to the worker's contract at the time the contract is issued to the worker.
b) A duplicate copy of this contract written in Korean written in English will be attached to the worker's contract when the contract issued to the worker. Without a duplicate of the English language contract written in Korean, the contract written in English is void. A duplicate contract written in Korean is required by the Korean court to prosecute commercial disputes between the employee and employer.
c) A "Certificate of Employment" will be attached to the worker's contract at the time the contract is issued to the worker.
d) A copy of the employer's "Rules of Employment" will be attached to the contract at the time the contract is issued to the worker.

This contract is void if documents 19(a)-19(d) have not been attached to the worker's contract when the contract is issued to the worker.

I did not see any sick days:

??) Sick Days

The employee will have 5 paid sick days during the thoughout contract period. A doctors note will be required by the employer when the employee missess more than two days in a row due.

While I read over your contract I didn't see anything about a E2 Visa Run.

??) Visa Run

The employer will pay for round trip costs for the worker's visa run to Japan. These costs shall include transportation from the worker's lodging in Korea to the international airport, Korean Airport Tax, flight fare to Japan, ferry fare to Japan, transportation costs from the airport to the worker's hotel or guest house lodging, the total cost of the worker's lodging while in Japan, cost of food, cost of transportation to the Korean Embassy in Japan, return cost from the Embassy to the worker's lodging, cost for processing the work visa, return flight from Japan to Korea, return ferry fare to Kore, transportation from the airport back to the worker's lodging, and all other expenses associated or required for the trip. Following the worker's round-trip visa run to Japan, the worker will be take a 12 hour rest period before actively teaching.

??)Transporting Students and Staff
The worker will be prohibitied from transporting students, and other workers for any purposes whatsoever throughout the contract period.

??) Letter of Release

In the event that the worker seeks release from this contract, the employer must issue a letter of release to the worker upon request, without delay or fee being charged to the worker or potential employers. Under no circumstances shall the employer refuse the worker a letter of release or hinder the worker from securing future employment in Korea.

??) Advance notice of dismissal

The employer shall give an advance notice to the worker at least 30 days before dismissal.
