Hi. I'm a newbie to all this.
I have some serious questions for all of you who have experience with teaching in Korea. If you are so obliged to give me your feedback,
I'd greatly appreciate it!
I have gotten two job offers at private hagwans paying the same ammount (2million w. a month). From all the negative feedback I've heard and read about taking EFL jobs in Korea I am understandably nervous about it. One of the employers (not mentioning names yet) seems to have several bad reviews and the other has a good reputation, but the current teacher has described the elementary students as "bloody disrepectful." I've been having these phobias of coming to Korea to teach even though it is something I want to do. Should I go for the hagwan (sp?) with the unruly kids and take it as a challenge or let it go based on first hand testimonials?
On top of that is the warning on the U.S. Department of State website against taking jobs in Korea. Ok, that really one is not that much of a concern as much as my desire to know if anyone has had a good experience teaching in Korea and have their employers held up to the contracts?
I want to mention names of the schools and hear what anyone has to say about them, but I'm not sure if that's legit here? Don't know the protocol since it's my very first post yet!

Hey I made a full length post and accidentally hit the wrong button and it cleared.
Long post short: just post the details of your two contracts. We'll try to offer advice as to what you should do.
Regarding disrespectfulness, just expect it. It's probably going to be the case. Disciplinary measures are always a huge part of the learning process when teaching ESL.

Contract 1)
Contract of Employment
This Contract of Employment has been made this ______________, by and between XXXXXX, having its office at xxxxxxxx, #########, Korea (hereinafter referred to as "employer"), and _******** __________, citizen of USA, whose address is ____________________________________________, (hereinafter referred to as "employee").
Employer and employee agree as follows:
1. Contract Period
Employee accepts employment from employer to teach the English language, under the terms and conditions set forth here in this agreement for a period of twelve full and consecutive months, commencing on ___arrival to Korea__________________.
2. Responsibilities of Employee
2.1 Duties
(A) During the term of this agreement, the employee will be required to prepare for, teach, and carry out all required administrative duties connected with, classes assigned by the employer. Payment made for assigned teaching periods is inclusive of payment for preparation and administrative duties connected with those assigned classes. Employee agrees to attend all meetings and training workshops scheduled by employer. The purpose of meetings and workshops is to inform employee of matters relating to employee's duties and the institute's operation, or to assist in employee's professional development. No payment in excess of or in addition to employee's monthly salary will be made for attending meetings scheduled by employer.
(B) The teacher is expected to devote no less than 1 hour a day at the institute for the lesson planning with co-teachers, student evaluations, syllabuses, report cards, field trips, supervision of play, maintenance of the English environment during breaks, workshops, and upgrading ones professional knowledge and skills without additional pay The work week will follow the yearly academic calendar issued by the school.
2.2 Teaching hours
The minimum teaching requirement is 120 teaching hours per month. A "teaching hour" typically consists of a fifty five minute teaching period with a five minute break. Monday through Friday(2:00pm~8:30pm) are teaching days except for scheduled public holidays and vacation days. Teaching hours in excess of the above minimum requirement will be paid overtime, at a rate to be mutually agreed between employer and employee.
2.3 Conduct of Employee
At all times during the term of this agreement, employee will directly adhere to and obey all the rules and regulations that have been, or may hereafter be established, by employer for the conduct of employee at the place of employment.
3. Compensation and Other Treatment of Employee
3.1 Salary
Employer will pay employee, for the above minimum teaching requirement, the amount of _2.0million __________ Won for each month of this agreement. Korean income taxes (5%) and Korean National Pension Scheme deductions will be withheld. Monthly salary payments will be made on the _start____ day of each month, or the first working day thereafter if the _start day____ is a Sunday or public holiday. 3.2 Housing
Employer will select and provide furnished living accommodation for employee. Each employee will have a private bedroom, but kitchen and bathroom may be shared with another employee. Employee is responsible for all utility payments pertaining to employee's accommodation. Employee accepts responsibility for any payment due to employee's landlord owing to damage caused by employee's occupation of the residence.
3.3 Severance Payment
Dependent on completion of one full calendar year of employment with employer, employee will be given, exclusive of monthly salary payments, a bonus of an amount equal to employee's final monthly salary. Korean severance tax will withheld. This payment is made immediately on completion of the contracted period.
3.4 Airfare
Employer will provide employee with a round-trip economy class air ticket to Korea from an international airport, to be mutually agreed by employer and employee. In the case that employee is already in Korea, employer will provide employee with only returning ticket to his/her country.
3.5 Medical Insurance
Employee will be covered by medical benefits under the Korean Medical Insurance Union, a Government Health Organization. The costs of this coverage will be borne half by employer and half by employee. Payment will be made by monthly deduction from employee's salary.
3.6 Public Holidays and Vacation
Employee will be entitled to observe public holidays, and receive an additional ten vacation days, during the contracted period. School's summer vacation and winter vacation will be included in "additional ten vacation days". The remaining holidays will be negotiated with the school director.
3.7 Accident Compensation
In the event that employee sustains injuries from an accident or mishap which occurs outside the course of normal work duties, employee understands and agrees that employer will have no responsibility for, nor obligation to pay, medical and hospital costs which are in excess of those covered by medical insurance.
4. Termination of Contract
4.1 Notice Period
This contract may be terminated by either employer or employee, on condition that two full teaching months' prior written notice is given of the intention to terminate. In the event that the contract is terminated before completion of the term of the agreement, employer will pay salary due to date of termination. In the event of voluntary resignation or breach of contract by employee, employer reserves the right to require reimbursement for employee airfare.

4.2 Gross Misconduct

b. c. The teacher agrees to teach 100 teaching hours a session, while adequately preparing for each class. The said workload is equal to 150 forty-minute classes per session. (Each session is approximately one month in duration)
CLAUSE 6 (SALARY AND OVERTIME RATE)
a. The employer agrees to pay the teacher salary of 2,000,000 Korean Won for 100 teaching hours per session and preparation for classes.
b. The payment of the teachers� salary is to be made on day of each month, after the required work is completed.
c. Each forty-minute class exceeding the 150 classes/session will be considered as overtime. The payment for the overtime will be 15,000 Korean Won per forty-minute class. Attendance at scheduled staff meetings and workshops, along with preparation for classes is mandatory and not considered as overtime.
CLAUSE 7 (TAX)
Income tax and inhabitants� taxes will be withheld from the salary in accordance with the Korean laws. (Approximately 3.3% of total income)
CLAUSE 8 (TRANSPORTATION)
a. Round trip economy airfare is provided with the one-year contract from the teacher�s nearest airport to the international airport in Korea. Transportation from the airport to the "xxxxxxxxx"school in where the teacher will be teaching, will be provided.
b. If the teacher leaves the school prior to completing 12 months for any reason as agreed to in this contract, the teacher must reimburse the school the cost of the airfare paid by the school or the school may deduct the equivalent amount from the teacher�s last month�s pay.
CLAUSE 9 (ORIENTATION PERIOD)
a. Upon arrival in Korea, the teacher will be guaranteed three days for orientation, training, and general time to settle down, before being expected to begin his/her regular teaching work.
b. During the orientation period the teacher is required to attend the official �xxxxxxxx� training at the head office, learning about the school system. Upon completion, the teacher will receive a certificate, becoming a certified "XYZZZZZZ� teacher.
a. Medical insurance is to be provided by Korean Medical Insurance Union or a different private health insurance company/organization.
b. Half of the insurance premium is to be paid by the employer, while the other half is to be covered by the teacher.
CLAUSE 11 (VACATION & HOLIDAYS)

The teacher will be allowed holidays during national holidays, while vacation days are allowed only during the days allowed/stated in the xxxxx session calendar.
CLAUSE 12 (ACCOMMODATIONS)

a. The school will provide the teacher with furnished accommodation.
b. Furnishings being provided by the employer include: television, refrigerator, washing machine, bed, wardrobe, fan, kitchen table, basic utensils, chairs, two-burner gas hot plate, and a telephone. The teacher will be expected to provide his/her own pillow, pillowcase, and sheets, etc.
c. Selection of the apartment and its location is to be made by the employer, and will be made without consulting with the teacher.
cd. The deposit and monthly rent is the full responsibility of the employer.
.e. Any and all other living costs are to be the full responsibility of the teacher. (All utilities: gas, electricity, telephone, cable, internet, etc.)
f. For the first three months, the Employer will withhold a safety deposit of 100,000 Korean Won each month, for a total deposit of 300,000 Korean Won. This deposit is used to pay off utility and telephone charges unpaid at the resident, if any. After the employer clears all utilities and miscellaneous bills and conformation is received, the deposit (minus any remaining dues) is to be returned to the teacher. However, if the total remaining dues exceed the 300,000, the teacher is entirely responsible, and is to satisfy all debts with the employer and/or utility companies.
g. Any and all unpaid balances of services utilized while residing at the furnished apartment is the responsibility of the teacher.bills have been paid will be transferred to the teacher�s account back home two months after the termination of the contract.
CLAUSE 13 (SEVERANCE PAYMENT)
Upon completion of this one-year contract, the teacher will receive a severance payment of 2,000,000 Korean Won, equal to one month�s salaries, in accordance with Korean Laws. This payment will be made at the time of completion of the contract period and any and all income taxes are to be withheld.
CLAUSE 14 (DISMISSAL OR VOLUNTARY RESIGNATION)
a. The employer reserves the right to dismiss the teacher from employment for the following causes:
?. Neglect or inability to perform his/her duties stipulated in this agreement
?. Frequent absences from work
?. Receiving two warning letters
?. Criminal behavior or misconduct
b. The employer agrees to give the employee the courtesy of 20 working days notice in the event of dismissal. However, in the case of a teacher�s criminal behavior, misconduct, or with any discretion thereof, he/she will be dismissed from employment immediately, without warning or notice. Overall, the employer reserves to right to dismiss an employee at anytime.
c. In the event the teacher resigns from employment, he/she can do so giving 30 working days notice to the employer.
CLAUSE 15 (GOVERNING LAW & JURISDICTION)
a. This Agreement is governed under the laws of the Republic of Korea and any breach of this contract, of any form, may result in prosecution through the legal system in the Republic of Korea.
b. This Agreement is made final and firm unless any material modification or amendment to this Agreement is executed with the full knowledge and consent of the undersigned and incorporated into this Agreement.

Important questions to ask: How much prep is required? How often and what duration are the meetings? List all administrative duties clearly!

Read 1 hour a day unpaid! Thats a lot of unpaid time especially with the other unpaid time added in!

As I have said many times you should only ever agree to classes per week...never hours per month...25 fifty minute classes a week is plenty, anything more than that should be overtime!

At all times during the term of this agreement, employee will directly adhere to and obey all the rules and regulations that have been, or may hereafter be established, by employer for the conduct of employee at the place of employment.
Not a snowballs chance in hell of agreeing to this clause! All rules and regulations should be stated clearly in the contract...not added on at the employer whim!

3.1 Salary

How long is a session? 3 weeks? 2 weeks? a month? Clear language needs to be in a contract especiallly when dealing with working hours!

Overtime is crap....anything less than 20,000 is a joke! IF a session is one month you will be teaching 8 classes per day+ way way too many!

CLAUSE 8 (TRANSPORTATION)
a. Round trip economy airfare is provided with the one-year contract from the teacher’s nearest airport to the international airport in Korea. Transportation from the airport to the "xxxxxxxxx"school in where the teacher will be teaching, will be provided.
b. If the teacher leaves the school prior to completing 12 months for any reason as agreed to in this contract, the teacher must reimburse the school the cost of the airfare paid by the school or the school may deduct the equivalent amount from the teacher’s last month’s pay.
After 6 months you should not be held libel for your airfare to Korea!
CLAUSE 9 (ORIENTATION PERIOD)
a. Upon arrival in Korea, the teacher will be guaranteed three days for orientation, training, and general time to settle down, before being expected to begin his/her regular teaching work.

b. During the orientation period the teacher is required to attend the official ‘xxxxxxxx’ training at the head office, learning about the school system. Upon completion, the teacher will receive a certificate, becoming a certified "XYZZZZZZ’ teacher.
a. Medical insurance is to be provided by Korean Medical Insurance Union or a different private health insurance company/organization.
b. Half of the insurance premium is to be paid by the employer, while the other half is to be covered by the teacher.
NHIC is 2.24% each!
CLAUSE 11 (VACATION & HOLIDAYS)

The teacher will be allowed holidays during national holidays, while vacation days are allowed only during the days allowed/stated in the xxxxx session calendar.
Get a look at that calendar well in advance!
CLAUSE 12 (ACCOMMODATIONS)

a. The school will provide the teacher with furnished accommodation.
b. Furnishings being provided by the employer include: television, refrigerator, washing machine, bed, wardrobe, fan, kitchen table, basic utensils, chairs, two-burner gas hot plate, and a telephone. The teacher will be expected to provide his/her own pillow, pillowcase, and sheets, etc.

c. Selection of the apartment and its location is to be made by the employer, and will be made without consulting with the teacher.
cd. The deposit and monthly rent is the full responsibility of the employer.
.e. Any and all other living costs are to be the full responsibility of the teacher. (All utilities: gas, electricity, telephone, cable, internet, etc.)
Hmmm location should be within 5-10 minutes walk to school!
f. For the first three months, the Employer will withhold a safety deposit of 100,000 Korean Won each month, for a total deposit of 300,000 Korean Won. This deposit is used to pay off utility and telephone charges unpaid at the resident, if any. After the employer clears all utilities and miscellaneous bills and conformation is received, the deposit (minus any remaining dues) is to be returned to the teacher. However, if the total remaining dues exceed the 300,000, the teacher is entirely responsible, and is to satisfy all debts with the employer and/or utility companies.
When? Dont agree to deposits...provide reciepts for your bills throughout the year and they are not needed!
g. Any and all unpaid balances of services utilized while residing at the furnished apartment is the responsibility of the teacher.bills have been paid will be transferred to the teacher’s account back home two months after the termination of the contract.

CLAUSE 13 (SEVERANCE PAYMENT)
Upon completion of this one-year contract, the teacher will receive a severance payment of 2,000,000 Korean Won, equal to one month’s salaries, in accordance with Korean Laws. This payment will be made at the time of completion of the contract period and any and all income taxes are to be withheld.
CLAUSE 14 (DISMISSAL OR VOLUNTARY RESIGNATION)
a. The employer reserves the right to dismiss the teacher from employment for the following causes:
?. Neglect or inability to perform his/her duties stipulated in this agreement
?. Frequent absences from work
?. Receiving two warning letters
?. Criminal behavior or misconduct
b. The employer agrees to give the employee the courtesy of 20 working days notice in the event of dismissal. However, in the case of a teacher’s criminal behavior, misconduct, or with any discretion thereof, he/she will be dismissed from employment immediately, without warning or notice. Overall, the employer reserves to right to dismiss an employee at anytime.
c. In the event the teacher resigns from employment, he/she can do so giving 30 working days notice to the employer.
CLAUSE 15 (GOVERNING LAW & JURISDICTION)
a. This Agreement is governed under the laws of the Republic of Korea and any breach of this contract, of any form, may result in prosecution through the legal system in the Republic of Korea.
b. This Agreement is made final and firm unless any material modification or amendment to this Agreement is executed with the full knowledge and consent of the undersigned and incorporated into this Agreement.

On top of that is the warning on the U.S. Department of State website against taking jobs in Korea. Ok, that really one is not that much of a concern as much as my desire to know if anyone has had a good experience teaching in Korea and have their employers held up to the contracts?

I don't think the teacher's comments about the students is valuable or useful information. I suspect it means that teacher doesn't have much experience in the classroom. However, whatever that teacher said about the boss is worth listening to.
Don't worry about the State Department warning. It is there because they've heard the horror stories about hakwons, but can do nothing about it. If you take a job in Korea, don't expect Condi Rice to come running if you have a problem. That isn't her job.
There are people who have had good experiences in hakwons. There are millions of stories from people who have had rotten experiences. Both are true. Working in hakwons is a dicey proposition.
Some (but not all) of the problems working in Korea can be avoided by working in the public schools. The issues of late pay and bosses not paying the taxes, health insurance, pension plan and severance don't seem to come up in the public schools.
Consider that before making the choice to work in a hakwon or public school. |
